(a) In addition to the enforcement processes and penalties provided in this article, any condition caused or permitted to exist in violation of any of the provisions of this article shall be considered a threat to the public health, safety, welfare and the environment, may be declared and deemed a nuisance, and may be summarily abated and/or restored by, or at the direction of the Village, by its Mayor. The Village may initiate any civil actions in the Circuit Court of Cabell County as necessary to abate, enjoin or otherwise compel the cessation of such nuisance, including a requirement for the person to conduct environmental remediation.
(b) The cost of such abatement and/or restoration shall be the sole responsibility of the owner of the property and the cost thereof shall be a lien upon and against the property. Such lien shall continue in existence until the same shall be paid.
