1068.02 INVOLUNTARY DISPLACEMENT; NOTICE REQUIRED; ASSISTANCE.
   The threshold requirements to assist involuntary displacements who are not protected under the Uniform Act are as follows:
   (a)   Minimum Notice. All persons who will be displaced as a result of Community Development Block Grant activities must receive at least sixty days advance notice of the date the displacee will be required to permanently move from the occupied site.
   (b)   Technical Assistance. The City shall provide technical assistance to the displacee, including, but not limited to:
      (1)   Social services designed to mitigate adverse effects of displacement on low and moderate income persons;
      (2)   A determination of family housing needs and referrals; and
      (3)   Assisting low income marginal businesses in finding suitable alternative locations and/or facilities.
   (c)   Financial Assistance. The City shall provide for basic financial relocation assistance to mitigate financial hardships on low and moderate income households and small and marginal businesses as follows:
      (1)   Source of funds. Funds to cover local costs under this plan may be derived from any one or a combination of the following sources:
         A.   Community Development Block Grant Formula funds or competitive grant proceeds for the activity affected;
         B.   Local government funds; and/or
         C.   Private developer or beneficiary of Community Development Block Grant financial assistance.
      (2)   Moving expenses. The City shall reimburse moving expenses and other services in an amount not less than the following schedule:
         A.   Residential - Tenants.
            1.   When the relocatee owns the furnishings, payment will be one hundred dollars ($100.00) for the first room and fifty dollars ($50.00) for each additional room, up to a maximum of three hundred dollars ($300.00).
            2.   A relocatee in a furnished dwelling shall receive one hundred dollars ($100.00).
            3.   Owner/occupant assistance shall be at the grantee's discretion.
               All schedules shall receive an additional two hundred dollars ($200.00) for dislocation allowance.
         B.   Nonresidential - Tenants.
            1.   Documented actual moving expenses may be paid, not to exceed two thousand, five hundred dollars ($2,500).
            2.   Owner/occupant assistance shall be at the grantee's discretion.
      (3)   Replacement housing payments.
         A.   Homeowner. Payments and/or services shall be at the grantee's discretion.
         B.   Tenants. The grantee must provide a written referral to affordable, decent, safe and sanitary housing. If such housing cannot be made available, the grantee shall provide financial assistance to make the referred housing affordable for a twenty-four month period.
