1064.01 RULES AND REGULATIONS.
   (a)   Those areas of the City which have been designated by the office of the Recreation Coordinator and/or Council as being for recreational or park purposes shall be defined as parks. Any reference to parks and swimming pools in this chapter or elsewhere in these Codified Ordinances, or in City rules or regulations, shall mean such areas.

   (b)   The following are prohibited by any person in the parks:
      (1)   Placing, throwing, scattering or distributing refuse, garbage, junk, debris, paper or other rubbish;
      (2)   Distributing any and all circulars, cards and handbills, whether written or printed, except political and religious matter;
      (3)   Mutilating, defacing, destroying, removing, breaking or tearing any structure, wall, fence, railing, vehicle, plant, shrub, tree, sign or other property;
      (4)   Injuring, destroying, harassing, chasing or harming wild or domestic animals, fowl or fish;
      (5)   Using seats or benches for sleeping facilities for more than three hours on a continuous basis;
      (6)   Interfering with other users of the parks and recreational facilities by words or actions which are beyond the scope of self-use;
      (7)   Hanging or allowing to swing any hammock or swing upon trees, posts, fences or other park property not specifically constructed for swing purposes;
      (8)   Using, drinking or consuming alcoholic beverages, unless:
         A.   Such use, drinking or consumption is pursuant to a valid Class F Liquor Permit issued by the Ohio Department of Commerce, Division of Liquor Control, the said application for which has been approved by the Office of the Mayor and for which adequate security is provided; or
         B.   Unless such use is in conjunction with a scheduled function held at either Avon Isle or the Avon Community Center pursuant to lease with the City at which alcoholic beverages will be provided at no charge to the guests, the said application for which has been approved by the office of the Mayor, and for which adequate security is provided.
      (9)   Starting and/or using ground fires except at fireplaces provided for such purpose;
      (10)   Smoking in prohibited areas as designated by the office of the Recreation Coordinator;
      (11)   Operating a motorized vehicle on a walking track, with the exception of motorized wheelchairs;
      (12)   Swimming or wading in ponds;
      (13)   Ice skating in any area other than the designated skating rink;
      (14)   Discharging any firearm or using a bow and arrow, B.B. guns, pellet guns, paint ball guns and sling shots;
      (15)   Hitting golf balls;
      (16)   Using bicycles, skateboards, rollerblades or roller skates on or within any pavilion, gazebo or other structure, except as permitted in Section 1064.011 by the Skateboard Facility at Little League Park rules; and
      (17)   Feeding wildlife, particularly, the wild geese. For purposes of this section, “wildlife” shall be defined as living things, especially mammals, birds, and fishes that are neither human nor domesticated.

   (c)   The following are prohibited in the parks by a custodian and/or owner thereof:
      (1)   Driving of vehicles over grass and/or areas not designated as vehicle areas or roadways;
      (2)   Making use of park driveways by vehicles which are of a commercial nature and/or for business uses;
      (3)   Permitting goods, merchandise and personal property to remain in or upon any park or parkway in the nature of an obstruction to the free use and enjoyment of the park;
      (4)   Permitting or allowing a dog to be loose and/or without a leash;
      (5)   Participating in any game of chance which is in violation of the laws of the City or of the State;
      (6)   Displaying or showing products, wares or services for the purpose of transferring ownership or possession of the same;
      (7)   Parking motor vehicles in areas not specifically designated as parking areas;
      (8)   Leaving the droppings of dogs or other domestic animals on park property; and
      (9)   Permitting or allowing a horse on park property.

   (d)   The following are prohibited by any person in the parks except by a written permit authorized by the office of the Recreation Coordinator’srules and regulations:
      (1)   Placing and/or posting signs, bills and bulletins;
      (2)   Permitting entry into a park by animals over which the person has custody, other than a dog or cat; and
      (3)   Displaying, firing, exploding or shooting pyrotechnical displays, firearms, fireworks, explosives, firecrackers and sparklers.
   (e)   All parks shall be closed from 10:00 p.m. to 8:00 a.m. of the next day, unless otherwise authorized by the Office of the Recreation Coordinator. Persons claiming to hold permits for use shall produce the same upon the request of the police, park employees, Councilmen, City officials or office of the Recreation Coordinator. Permits are limited to the use specified therein. Permit forms adopted by the office of the Recreation Coordinator are deemed a valid exercise of the Recreation Coordinator’s authority and failure to comply with permit requirements are punishable under this section.

1064.011 RULES FOR SKATEBOARD FACILITY AT LITTLE LEAGUE PARK.
   (a)   All rules and regulations set forth in Section 1064.01(b), (c), (d), and (e) shall apply to Skateboard Facility at Little League Park.
   (b)   The following are additional rules and regulations to be adhered to specifically at the Skateboard Facility located at Little League Park:
      (1)   No modifications to the skating surfaces or features shall be permitted and skating is restricted to the features specifically designed for that purpose;
      (2)   Use of drugs and alcohol is strictly prohibited;
      (3)   Tobacco use by minors or the use, sale or possession of drugs is prohibited;
      (4)   Use of abusive, threatening, obscene or profane language is prohibited;
      (5)   Excessive noise is prohibited;
      (6)   No food or beverage shall be allowed within the fenced area;
      (7)   No motorized skateboards, bicycles, scooters, cycles, vehicles or other devices other than skateboards and/or in-line skates are permitted in the skateboard facility; and
      (8)   The hours of operation shall be from 8:00 a.m. until dusk.

1064.012 RULES FOR DOG PARK AT VETERANS MEMORIAL PARK.
   (a)   All rules and regulations set forth in Section 1064.01(b), (c), (d), and (e) of the Codified Ordinances shall apply to the Dog Park at Veterans Memorial Park.
   (b)   The following are additional rules and regulations to be adhered to specifically at the Dog Park located at Veterans Memorial Park:
      (1)   The City does not supervise use of off-leash areas, and anyone using this area does so at his or her own risk.
      (2)   Dog owners are responsible for any injury or damage caused by their dog, per state law.
      (3)   Children under the age of sixteen must be accompanied by parent/guardian at all times. It is highly recommended that children younger than twelve stay outside of the fenced areas for their own protection.
      (4)   No more than two dogs per person allowed.
      (5)   Dogs must be healthy, fully immunized, dewormed, licensed as set forth in Section 618.08, and wearing ID tags as set forth in Section 618.095.
      (6)   Dogs must always be supervised and within sight and voice control of their handler. Owners of dogs using the fenced area must always remain within the fenced area.
      (7)   Female dogs in heat and non-neutered male dogs are prohibited.
      (8)   Muzzles, spikes or prong collars are NOT permitted on dogs in the fenced area.
      (9)   Dogs must be removed by their owners immediately at the first sign of aggressive behavior toward people or other dogs.
      (10)   Animals other than dogs are NOT permitted.
      (11)   No food, smoking, treats or toys items are allowed inside the fenced area.
      (12)   Dogs must be at least four months old to enter. No dogs larger than twenty-five pounds are permitted in the small dog area.
      (13)   Dogs that are classified as potential nuisance dogs, dangerous dogs or vicious dogs are prohibited as set forth in Section 618.19.
      (14)   Dogs must be leashed prior to entering and upon leaving the fenced area. Owners must have a leash visible at all times.
      (15)   Dog waste must be picked up immediately by the owner/handler and placed in the trash cans.
   (c)   Failure to comply with the posted rules and regulations may result in expulsion from the park in addition to the penalties set forth in Section 1064.99 of the Codified Ordinances.

1064.02 FORMAL DESIGNATION OF SCHWARTZ ROAD PARK AND NORTHGATE PARK.
   (a)   Those park lands commonly known as Schwartz Road Park are hereby officially named Schwartz Road Park. This designation shall be used as the name of said Park and so referenced and used in all official documents, records and communications.
   (b)   Those park lands commonly known as Northgate Park are hereby officially named Northgate Park. This designation shall be used as the name of said Park and so referenced and used in all official documents, records and communications.

1064.03 FEES FOR USE OF PARK FACILITIES.
   (a)   Park Pavilions.
      (1)   Park pavilions are open for use by the residents of the City without charge. Residents seeking to reserve a date and time for the private use of a pavilion, shall pay a fifty dollar ($50.00) non-refundable permit fee to the office of the Recreation Coordinator.
      (2)   Nonresidents who reserve a date and time for private use of the pavilions shall pay a one hundred dollar ($100.00) non-refundable permit fee to the office of the Recreation Coordinator.

   (b)   Baseball Field Rental Rates.
      (1)   City baseball fields are open for use, when not reserved by permit, without charge, to residents of the City. Permits for the use of baseball fields by in-house groups may be obtained, without charge, through the office of the Recreation Coordinator. An in-house youth group shall have priority to obtain permits.
      (2)   Each team will maintain a roster of each player. Said roster will contain the actual name and address of each participant. The Recreation Coordinator may use this roster to determine the appropriate fee to be applied. Failure to provide a roster before the first week of play will result in the imposition of the highest non-resident group fee.
      (3)   Avon Little League shall have priority use of baseball fields, provided that it obtains a use permit from the office of the Recreation Coordinator. No fee shall be charged for such permit.
      (4)   Fees for a use permit for baseball fields may be waived by consent of the office of the Recreation Coordinator, where the baseball field is to be used by a City of Avon school sports program.

   (c)   Multi-Use Field Rental Rates (e.g. Soccer, Lacrosse and Football Fields).
      (1)   City multi-use fields are open for use, when not reserved by permit without charge, to residents of the City. Permits for the use of the multi-use fields for soccer, lacrosse and football fields by in-house groups may be obtained, without charge, through the office of the Recreation Coordinator.
      (2)   Each team will maintain a roster of each player. Said roster will contain the actual name and address of each participant. The Recreation Coordinator may use this roster to determine the appropriate fee to be applied. Failure to provide a roster before the first week of play will result in the imposition of the highest non-resident group fee.
      (3)   The Avon Soccer League Association, Avon Youth Lacrosse Association and Avon Youth Football shall have priority use of the multi-use fields, provided that they obtain a use permit from the office of the Recreation Coordinator. No fee shall be charged for such permit.
      (4)   Fees for a permit for multi-use fields may be waived by consent of the office of the Recreation Coordinator, where the multi-use field is to be used by a City of Avon school sports program.

   (d)   Disposition of Funds. All fees collected from residents pursuant to this section shall be deposited in the Fields and Pavilion Deposit Account of Trust Fund No. 701. All fees collected from nonresidents shall be deposited in the Park Operating Fund, No. 651.

1064.04 FORMAL DESIGNATION OF CERTAIN PARK LAND AS HERITAGE SQUARE AT FRENCH CREEK.
   The park land located at the corner of Detroit Road and Stoney Ridge Road is hereby officially designated and named Heritage Square at French Creek.

1064.05 DESIGNATION OF VETERANS MEMORIAL PARK.
   (a)   The lands acquired by the City for park purposes located south of Detroit Road in the vicinity of the intersection of Moon Road and Detroit Road, and formerly known as the Betzel property, is hereby designated and officially named Veterans Memorial Park.
   (b)   All references to this park land, including but not limited to maps and other official documents, shall bear the designation, identification and name of Veterans Memorial Park.
