1026.01 ADOPTION OF STANDARD DESIGN; OTHER SPECIFICATIONS.
   (a)   The drawing and specifications set forth in Exhibit "A" following this chapter are hereby adopted as the standard design and as an approved method for the construction, building and maintenance of private driveways and drains for driveways in the City, and the same shall be considered a part of this chapter.

   (b)   Any matter or thing pertaining to the construction, building and maintenance of private driveways and drains for driveways in the City, for which there is no specification set forth in Exhibit "A" following this chapter, shall be governed by specifications set forth by the Director of Public Service, who shall follow recommended good practice.
1026.02 GRADING; COMPLIANCE WITH STANDARD DESIGN REQUIRED.
   No person shall grade a private driveway, drain for driveways or lawn without complying with the standard design and the specifications of the Director of Public Service.
1026.03 APPLICATION OF STANDARD DESIGN TO EXISTING DRIVEWAYS.
   The standard design shall not apply to driveways, drains for driveways and lawns which have already been installed and constructed prior to the effective date of this chapter (Ordinance 594, passed September 28, 1960), but if any changes are made at the request of the owners of the property where the driveways and drains are installed, or if changes in driveways or drains for driveways are ordered by the Director of Public Service or Council, such changes shall be made according to the standard design and the specifications of the Director of Public Service.
1026.04 PRIVATE DRIVEWAYS IN RESIDENTIAL DISTRICTS.
   Driveways not within a platted subdivision, where the residence has a front yard setback in excess of seventy-five feet from the City right of way, shall have installed a concrete apron within the City right of way pursuant to City standards and shall have installed a hard surface apron the width of the entrance of the garage extending a minimum of twenty feet from said entrance. Any residence within a seventy-five foot setback from the City right of way shall have installed a concrete apron within the right of way pursuant to City standards and have installed a hard surface driveway to the garage entrance. "Right of way" shall be as defined and determined in Section 1222.02 of these Codified Ordinances.

1026.99 PENALTY.
   Whoever violates or fails to comply with any of the provisions of this chapter is guilty of a minor misdemeanor and shall be fined not more than one hundred dollars ($100.00) for each offense. A separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues.
