§ 10.17 BOATING AND LAKES.
   Subd. 1.   Motorboat operation. The operation of motorboats shall be permitted upon East Side Lake and upon any body of water located in any public park or grounds of the city without restriction as to the time of the year they are being operated; provided that, the operation of the motorboats shall be governed and restricted by the following terms and conditions:
      A.   Motorboats shall be operated on East Side Lake and upon any body of water located in any public park in accordance with the rules and regulations set forth in M.S. Chapter 361, as it may be amended from time to time, which rules and regulations are hereby adopted by reference and made a part of this section.
      B.   No motorboat, except those powered by an electric motor, shall be operated upon any body of water in the city before 9:00 a.m. and after sunset on weekdays or before 12:00 noon or after sunset on Saturdays and Sundays.
      C.   All motorboats shall move counter-clockwise on East Side Lake at all times.
      D.   It is unlawful for any motorboat to be operated outside the boundaries of the buoys located on East Side Lake.
      E.   Notwithstanding any other provision of this section, the Council may order East Side Lake temporarily closed to boats and boating and other use for the periods as it may deem necessary for the purpose of making tests in the lake, cleaning out the lake or for reasons of public safety.
      C.   During the times as the lake is closed to public use, appropriate signs shall be erected around the lake not less than three in number, advising as to the duration and nature of the restriction of the use of the lake. It is unlawful for any person to place or operate any boat on the lake or make use of the lake contrary to the Council’s order.
   Subd. 2.   Temporary exemptions. Temporary exemptions to this section may be granted by the Council.
   Subd. 3.   Other exemptions. Resource management, enforcement and emergency personnel, when acting in the performance of their assigned duties, shall be exempt from the provisions of this section.
   Subd. 4.   Defacing trees, structures or embankments near East Side Lake. It is unlawful for any person to deface any trees, structures or embankments upon land owned by the city or by the state adjacent to East Side Lake.
   Subd. 5.   Defacing bath houses or other property. It is unlawful for any person to make, cut or deface, in any manner, the floor, walls, partitions or any part of the bath houses or tourists kitchen or playground or swimming apparatus located in any park belonging to the city.
