§ 9.31 SNOW EMERGENCY PARKING.
   Subd. 1.   Definition. For the purpose of this section, the following definition shall apply unless the context clearly indicates or requires a different meaning.
      A.   VEHICLE. Every device in, upon or by which any person or property is or may be transported or drawn upon a highway, except devices moved by human power or used exclusively upon stationary rails or tracks.
   Subd. 2.   Declaration of emergency; term and notice of emergency.
      A.   Whenever, in the opinion of the City Engineer, an emergency exists in the city, or in a section thereof, because of snow, freezing rain, sleet, ice, snow drifts or other natural phenomena, which create or are likely to create hazardous road conditions impeding, or likely to impede, the free movement of fire, health, police, emergency or other vehicular traffic, or the safety and welfare of the community, the City Engineer may declare an emergency to exist for a period of 72 hours, but the emergency may be terminated if conditions permit.
      B.   If the City Engineer is unable to act, the emergency may be declared by his or her representative.
      C.   Notice of the emergency shall be given by radio, television or press, which news media shall be requested to cooperate with the city and, when given the notice, shall constitute due and proper notice.
      D.   The notice shall specify the hour that the emergency commences and there shall be an interval of at least six hours between the first time that notice is given and the commencement of the emergency.
   Subd. 3.   Restrictions on parking on certain streets and parking lots. During an emergency, it is unlawful to park or leave standing any vehicle on any portion of the following streets or parking lots from 1:00 a.m. to 8:00 a.m.:

   Subd. 4.   Exceptions. This section shall not apply to:
      A.   Persons in charge of wreckers or authorized emergency vehicles while actually servicing mechanical, fire, police or medical emergencies;
      B.   The parking of vehicles directly in front of all-night eating establishments during the emergency between the hours of 1:00 a.m. and 8:00 a.m., if the owner or operator of the vehicle is inside the eating establishment while it is parked, and is available to move the vehicle if it is hindering snow removal operations; and (If the owner or operator does not remove his or her vehicle when requested by a police officer or a city employee engaged in removing snow, the vehicle may be removed as provided in the City Code.)
      C.   The parking of vehicles on streets other than emergency routes during the period of the emergency that are directly in front of business places during business hours unless the vehicle in front of the business establishment is hindering snow removal.

   Subd. 5.   Unlawful acts. During an emergency, it is unlawful to park or leave standing any vehicle on any street or city-owned parking lot listed in Subd. 3 above during prohibited hours, on any other street between the hours of 8:00 a.m. and 8:00 a.m. of the succeeding day, bearing odd-numbered United States Post Office address on even-numbered days of the month or on any other street between the hours of 8:00 a.m. and 8:00 a.m. of the succeeding day, bearing even-numbered United States Post Office address on odd-numbered days of the month.
