MINOR SUBDIVISION PROCEDURES.
(a) Planning Commission May Approve. The Planning Commission may approve a minor subdivision, as defined in Chapter 1103 herein, if such minor subdivision complies with all provisions of these Regulations. Any easement or right-of-way to be accepted on a plat requires approval and acceptance by City Council.
(b) Procedure for Minor Subdivision Plat.
(1) The original and copies of the minor subdivision plat, as required by the Planning and Zoning Director, along with the application fee established by ordinance of Council shall be submitted to the Planning and Zoning Director not less than ten (10) business days before the Planning Commission meeting at which consideration is desired.
(2) The Planning and Zoning Director shall refer the minor subdivision plat to the Planning Commission provided the proposed subdivision is not contrary to applicable planning, subdividing or zoning regulations, and that all information required for the Planning Commission to make a decision has been submitted.
(3) The Planning Commission shall review the proposed minor subdivision plat and approve, conditionally approve, or deny the subdivision plat with cause.
(4) Subsequent to approval by the Planning Commission, the applicant shall submit to the Planning and Zoning Director any materials required to comply with Section 1105.05.
(c) Modification of Minor Subdivision Plat. Except as otherwise provided in these Regulations, a minor subdivision plat shall not be amended without approval of the Planning Commission.
