1105.05 PLAT RECORDING PROCEDURES.
   The following procedures shall apply to the recording of subdivision plats.
   (a)   Requirements for Recording a Minor Subdivision Plat. After approval of a proposed minor subdivision plat, the applicant of the minor subdivision shall submit to the Director all documents and fees required to file the subdivision with the Office of the Portage County Recorder. Within twenty-one (21) days of receipt, the Director shall present the subdivision plat for filing with the County Recorder.
   (b)   Requirements for Recording a Major Subdivision. Subsequent to approval of a final major subdivision plat by City Council, and subsequent to City Staff approval of all other required submittals, the applicant shall comply with all conditions required prior to recording and shall submit to the Planning and Zoning Director all documents required by these Regulations, including but not limited to the development agreement, deposits, and fees required for filing the plat with the Office of the Portage County Recorder.
      Upon review, approval and execution of all items required by this Code, the Chair of the Planning Commission, the Director of Engineering, Utilities, and Inspection, the Planning and Zoning Director, and the Clerk or Deputy Clerk of Council shall place their signatures on the final plat, constituting final approval of the subdivision and authorization to file the plat for recording. Within twenty-one (21) days of receipt of the complete, approved, fully executed final plat, the Planning and Zoning Director shall present the plat to the Office of the Portage County Recorder for filing. The Director shall not file the plat unless:
      (1)   The construction of improvements is guaranteed by an executed development agreement, performance bond, or applicants security agreement, and any required deposits, or
      (2)   The development agreement is executed, construction of improvements is completed and approved, and the improvements are under maintenance bond or accepted by the City.
   (c)   Alternative Procedures for Constructing Improvements Prior to Recording. The applicant may request authorization to install the improvements prior to recording the final plat. The request shall be made in writing at the time the application for final plat is submitted to the Planning and Zoning Director. The Planning Commission and City Council may authorize delay of the filing of the plat for record until such time as the improvements have been installed and accepted. The applicant shall comply with all applicable requirements of these Regulations with regard to improvement plans, agreements and guarantees, inspections, fees, and related provisions, except that the performance bond may not be required, subject to approval by the Director of Law.
   (d)   Approval of Plats by Office of the County Recorder.
      (1)   Minor Subdivision Plats. The Office of the County Recorder shall be directed not to approve minor subdivision plats of land or partial plats of land in the City for recording upon County records until the same have been approved in writing thereon by the Planning and Zoning Director.
      (2)   Major Subdivision Plats. The Office of the County Auditor shall be directed not to approve major subdivision plats of land or partial plats of land in the City for recording upon County records until the same have been approved in writing thereon by the Chair of the Planning Commission, the Director of Engineering, Utilities, and Inspection, the Planning and Zoning Director, and the Clerk or Deputy Clerk of Council.
