952.02 DRAINAGE PIPE UNDER DRIVEWAY IN RIGHT-OF-WAY.
   (a)   The land owner is responsible for the initial installation, and the initial cost of drainage piping under the driveway in the right-of-way. This shall be installed under the specifications contained in Codified Ordinance Section 1323.01.
   (b)   The City shall inspect and report to the landowner any problems with the drainage pipe described above.
   (c)   If the drainage pipe has restricted flow, the City may clean the pipe to remove the restriction, and the City shall pay for the cleaning process.
   (d)   If the drainage pipe is too small or has deteriorated causing restricted flow; the City shall replace the pipe with the appropriate size and construction. If the drive way portion over the drainage pipe area needs restoration, the City shall restore this portion of the driveway using the same type material as found prior to restoration. (e.g. gravel to gravel, asphalt to asphalt, concrete to concrete). The City is responsible for all material costs (including drainage piping under the driveway) and all labor costs.
