A. Findings: It is hereby determined that the roads and streets within the boundaries of the City are being damaged and will continue to be damaged by certain heavy vehicles and that the damage to said roads has interfered and will continue to interfere with the safe and efficient use of the roads and streets of the traveling public within the City limits.
B. City Authority: It is hereby determined that pursuant to Idaho Code section 49-1005, the City has the authority to make regulations reducing the permissible weights of vehicles operated on the streets and roads within its jurisdiction as may be necessary for the protection of the road or for public safety and that the City shall erect and maintain signs designating such regulations.
C. Weight Restriction; Exception: It is unlawful for any person to drive or operate any vehicle of a gross weight in excess of ten thousand (10,000) pounds per axle upon any street or highway within the City, except: U.S. Highway 95 and Highway 54, when such streets or highways are properly posted pursuant to Idaho Code section 49-1005.
D. Penalties: Persons violating any of the provisions of this section shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be fined, but not to exceed one hundred dollars ($100.00) or imprisoned for not more than thirty (30) days in the Kootenai County Jail, or by both such fine and imprisonment. A. Definitions:
AIR COMPRESSION BRAKE: Any type of friction brake for vehicles in which compressed air pressing on a piston is used to apply pressure to the brake pad to stop the vehicle.
JAKE BRAKE: Any engine braking mechanism which, when activated, opens exhaust valves in the cylinders after the compression cycle, releasing the compressed air trapped in the cylinders, and slowing the vehicle.
B. Use Of Air Compression And Jake Brakes Prohibited: The use of any air compression or "jake" brakes by vehicles or trucks within the City limits is hereby prohibited and shall be unlawful, except under emergency circumstances where the use of air compression or "jake" brakes is necessary to prevent an accident or injury to persons or property.
C. Penalty: Any person who uses air compression or "jake" brakes in violation of the law shall be deemed guilty of an infraction, punishable by a fine of up to one hundred dollars ($100.00). (Ord. 401, 4-7-2015)
