§ 1420.03 SIDEWALK AND CURB REQUIRED.
   (a)   Within the township, all property owners shall install, construct and maintain sidewalk and curbing along such property abutting any street, in accordance with the specifications of the Township Engineer, the Pennsylvania Uniform Construction Code (34 Pa. Code Chs. 401 through 405) and the subdivision regulations of the township under the following circumstances:
      (1)   Whenever a building is newly constructed and erected within the township;
      (2)   Whenever an alteration is made to an existing building. ALTERATION, as defined in the Pennsylvania Uniform Construction Code (34 Pa. Code Chs. 401 through 405), means a change or rearrangement in structural parts or in the means of egress; an enlargement, whether by extending on a side or by increasing the height; or the moving from one location or position to another; or
      (3)   Whenever subdivision approval is requested pursuant to the subdivision regulations.
   (b)   At the time of transfer or resale of any premises within the township and as part of the inspection conducted prior to the issuance of the required certificate of occupancy, the Building Inspector shall inspect all sidewalks, curbs and driveway aprons. Any and all sidewalks, curbs and driveway aprons in a state of disrepair shall be maintained, repaired and/or replaced prior to the issuance of the certificate.
   (c)   All sidewalks and curbs required to be installed, constructed and maintained pursuant to this section shall be installed according to the specifications of the Township Engineer, with curbing to be installed 16 feet back from the centerline of the township street upon which the property abuts, unless otherwise directed by the Township Engineer. With respect to the installation of curbing and sidewalks on property which abuts a state highway, the property owner must first request and receive PennDOT approval for the installation of such curbing and sidewalk and the location therefor.
   (d)   All construction, installation, maintenance and repair of sidewalks and curbing, as required in this section, shall be at the expense and cost of the property owner. In addition, any widening of the street deemed necessary shall be at the expense and cost of the property owner.
   (e)   Any waiver sought by the property owner of the aforementioned requirements of curbing and sidewalks must be submitted, in writing, setting forth his or her reasons and justification for the requested waiver, to the New Construction Committee, which shall review and decide all waiver requests. Appeals therefrom shall be governed by § 1420.18.
