(a) The municipality is authorized and directed to enforce this chapter. The same is hereby authorized and directed to establish and promulgate recycling regulations as to the manner, days and times for the collection of recyclable materials in accordance with the terms hereof and as to any other matters required to implement this chapter. The municipality may change, modify, repeal or amend any portion of said rules and regulations at any time.
(c) Pursuant to subsection (a) above, the following regulations have been established by the Board of Commissioners.
(1) A. All residents serviced by township trash collection must recycle clear and colored glass, plastic bottles (#1 and 2), aluminum and bi-metal cans and newspaper. Plastic bottles, aluminum, glass and cans must be rinsed, lids removed and placed in the blue container on the curbside prior to 7:00 a.m. on the day of the resident’s regular trash collection. Recyclables will be collected bi-weekly by the township’s designated contractor.
B. Leaves must also be separated from the trash stream by the residents. These leaves will be collected by the township on designated dates. Leaves must be raked or placed in bags or containers at the curbline on the designated dates. Leaves will not be collected if they are mixed with grass and clippings, branches, twigs, animal excrement or other foreign materials.
(2) The township will distribute to each resident serviced by township collection service a blue 20-gallon container for collection of materials. Lost or additional containers can be purchased from the township at a cost of an amount set forth by the Board of Commissioners in the fee resolution. These are limited to the present supply. Similar containers clearly marked “Recycling” may be used. These containers can be used for no other purpose than those described above.
(3) A. Residential living groups or units utilizing private trash pick-up (not collected by the township) shall be responsible to contract with that collector to recycle those items mentioned above. The method of recycling those materials shall be arranged with the private hauler.
B. These residential dwellings are also responsible to contract with a private contractor for the collection and removal of leaves.
(4) Commercial, institutional and municipal establishments shall be responsible to arrange with a private contractor to separate, collect and recycle high grade office paper, plastic bottles (#1 and 2), aluminum, clear and colored glass, corrugated paper, newsprint and leaf waste.
(5) All contractors collecting and disposing of refuse and recyclable materials from private residential properties or commercial, institutional or municipal establishments, must register with the township on a yearly basis and pay an annual license fee of an amount set forth by the Board of Commissioners in the fee resolution. The contractor must provide the township with a list of the properties being collected and a written quarterly report setting forth the quantities of materials being removed from each property. In addition, the contractor must submit proof of liability insurance and proof of worker’s compensation coverage as provided for in the State Worker’s Compensation Act, as amended July 2, 1993, being 77 P.S. §§ 1 et seq.
