(a) Violation of either Section 341.02 or Section 341.03 is a minor misdemeanor for a first offense, and a fourth degree misdemeanor upon the commission of a second or subsequent offense within one year of the date of conviction of a prior offense.
(b) Violation of Section 341.05(a) is a minor misdemeanor.
