(a) When Permit Required. No entity and/or individual shall play or use any loudspeaker, radio, audio system or other instrument or sound amplifying device which originates from or within a motor vehicle for the purpose of or with the effect of creating noise to attract attention to commercial, political or other activities without first obtaining a permit in accordance with subsection (b) hereof.
(b) Permit Application; Fees; Issuance.
(1) Every entity and/or individual desiring to conduct the activities described in subsection (a) shall make application for a permit authorizing said activity to the City Manager upon forms to be prescribed by the City Manager.
(2) Upon receipt of the aforesaid application, the City Manager shall issue the permit, provided that the City Manager is satisfied that the permit’s issuance will not result in unnecessary and unseemly noise to the detriment of the health, safety, welfare or comfort of any individual. No such permit issued shall be valid for more than three consecutive calendar days, nor shall any such permit be issued permitting such conduct after 7:00 p.m. or before 7:00 a.m.
(3) The fee for such permit shall be twenty-five dollars ($25.00).
