937.09 SEWER CREDIT FOR METERED WATER USED IN SWIMMING POOLS.
   (a)   A private swimming pool is defined for purposes of this Section as an open container designed to hold water for wading or swimming, with a depth at any point of at least 48 inches and a length or diameter, depending on the shape, of at least 12 feet. Hot tubs, jacuzzis, spas and children's play pools with a depth of less than 48 inches are not swimming pools for purposes of this Section.
   (b)   In order to qualify for the credit described in this Section, a private swimming pool permit must first be obtained under Chapter 1315 of these Codified Ordinances.
   (c)   A waste water treatment credit shall be allowed calculated on the volume of water used to fill a swimming pool in accordance with the following procedures:
      (1)   The credit is available only if metered water supplied by the local water utility company to the household where the swimming pool is located is used to fill it.
      (2)   Application shall be made to the City Finance Department on a form available from that Department. The form shall specify the applicant's name and address, the dimensions of the swimming pool (depth, length and width or diameter) and the date the pool was or is to be filled. The form shall contain a statement verifying the swimming pool will not be emptied into any drain or opening connected to the sanitary sewer system of the City. The form shall grant the City permission to enter upon the applicant's premises for the limited purpose of verifying that the pool is located there and that it is being or has been filled.
      (3)   Following approval of the application, the Finance Department shall credit the sewer bill for that period for sewer charges representing treatment of a volume of water equal to ninety per cent (90%) of the maximum capacity of the swimming pool. The credit may be applied in that billing period or, if the credit exceeds the total charge for the billing period, may be applied over the current and one following billing period.
      (4)   Only one such credit shall be allowed per household per calendar year.
