143.07 CHARGES FOR CITY EMERGENCY MEDICAL SERVICES.
   (a)    The Fire Chief of Ashtabula shall establish a rate for the use of the City's emergency medical services that is consistent with the usual and customary rates of third party payors. The Fire Chief shall notify the City Manager and City Director of Finance of said rate.

   (b)   The rate established by the Fire Chief for the use of the City's emergency medical services shall be a reasonable charge in the amount not less than the authorized Medicare reimbursement rate established under the Title XVIII of the "Social Security Act" 49 Stat. 620 (1935), 42 USCA 301, as amended. Said reasonable charge for the use of emergency medical services shall be charged regardless of the residency of said individual(s) utilizing the emergency medical services.
   (c)   Any balance due from users of City-provided emergency medical services who are either residents of the City of Ashtabula, employees of the City of Ashtabula, or employees of businesses located within the corporate limits of the City of Ashtabula who are reporting and paying income taxes to the City of Ashtabula, shall be waived after all insurance billing has been exhausted. In these cases, the taxes paid to the City in the form of real estate tax and/or income taxes shall be considered as full payment of the co-pay and/or non-insured transport.
   (d)   Except as set forth in subsection (c) hereof, all persons utilizing City-provided emergency medical services shall be billed for said services in full including any insurance deductibles and/or co-pays.
   (e)    This City Manager is authorized to enter into a contract or contracts with other entities to provide billing services in connection with the charges established above.

   (f)   When as a result of exhausting reasonable attempts to collect the charges, or as a result of unique operational circumstances, the Fire Chief determines it is necessary to amend, modify or write-off charges for medical services provided by the Fire Division, the Chief shall present the circumstances to the City Manager and the City Director of Finance. Upon the agreement of all three, charges may be amended, modified or written off.
