1361.01 DEFINITIONS.
   For purposes of the Housing Code the following words and phrases shall have the following meanings ascribed to them respectively.
   (a)    "Approved" means approved by the Director of the Housing Division or an employee of the Housing Division designated by the Director.
   (b)   "Basement" means a portion of a building located partly underground but having less than one-half of its clear floor-to-ceiling height below the average grade of the adjoining ground.
   (c)    "Cellar" means a portion of a building located partly or wholly underground and having one-half or more of its clear floor-to-ceiling height below the average grade of the adjoining ground.
   (d)   "Dilapidated" means no longer adequate for the purpose or use for which it was originally intended.
   (e)   "Dwelling" means any building, structure or part thereof which is used or intended to be used for living, sleeping and cooking.
      (1)    "Multiple dwelling" means any dwelling containing two or more dwelling units.
      (2)   "Two-family dwelling" means a building designed for or occupied exclusively by two families.
      (3)   "Dwelling unit" means a room or group of rooms located within a dwelling and forming a single habitable unit with facilities which are used or intended to be used for living, sleeping and cooking.
   (f)   "Extermination" means the control or elimination of insects, rodents or other pests by eliminating their harborage places, by removing or making inaccessible materials that may serve as their food, by poisoning, spraying, fumigating or trapping, by blocking their access to a dwelling or by any other recognized and legal pest elimination methods approved by a Health Officer of the City pursuant to appropriate City ordinances.
   (g)    "First story" means that story of a dwelling at or next above the average grade of adjoining ground.
   (h)    "Garbage" means the animal or vegetable waste resulting from the handling, preparation, cooking and consumption of food.
   (i)    "Habitable room" means a room or enclosed floor space used or intended to be used for living, sleeping, cooking or eating purposes, excluding bathrooms, water closet compartments, laundries, pantries, foyers or communicating corridors, closets, and storage spaces. Rooms used for periodic or temporary occupancy as recreation and game rooms, studies or dens, for the purposes of the Housing Code shall not be deemed to be habitable rooms.
   (j)    "Housing Inspector" means the Director of the Division of Housing of the City, appointed by the City Manager, or any person employed by the Division of Housing for the purpose of inspecting dwellings and other buildings and enforcing the Housing Code.
   (k)    "Housing Code" or "Housing Ordinance" means the provisions of Chapters 1361 through 1367 , inclusive, of the Codified Ordinances of the City of Ashtabula, as amended.
   (l)    "Infestation" means the presence, within or around a dwelling or in or near waste disposal containers, of any insects, rodents or other pests.
   (m)    "Occupant" means any person living, sleeping, cooking or eating in or having possession or use of a dwelling unit. (m) "Operator" means any legally responsible person who has charge, care or control of a building or part thereof in which dwelling units are leased or let.
   (n)   "Owner" means any legally responsible person who, alone or jointly or severally with others:
      (1)    Has legal title to any dwelling with or without actual possession thereof; or
      (2)    Has charge, care or control of any dwelling as owner or agent of the owner, or as executor, executrix, administrator, administratrix, trustee or guardian of the estate of the owner. Any person thus representing the owner shall be bound to comply with the provisions of the Housing Code to the same extent as if he were the owner.
   (o)   "Premises" means a platted lot or part thereof or unplatted lot or parcel of land or plot of land, either vacant or occupied by any dwelling or non-dwelling structure, and includes any such building, accessory structure or other structure thereon.
   (p)   "Properly installed" means installed in accordance with all applicable codes and ordinances of the City.
   (q)    "Plumbing" means water pipes, mechanical garbage disposal units, waste pipes, water closets, sinks, installed dishwashers and clothes washing machines, lavatories, bathtubs, shower baths, catch basins, drains, vents, and other similar supplied fixtures, including all connections to water or sewer lines.
   (r)   "Rental unit" means any dwelling structure, or that part of any dwelling containing one or more units that is rented or leased for residential occupancy.
   (s)    "Rooming house" means any dwelling, or that part of any dwelling containing one or more rooming units in which space is let by the owner or operator to three or more persons who are not husband or wife, son or daughter, mother or father, or sister or brother of the owner or operator.
   (t)   "Rooming unit" means any room or group of rooms forming a single habitable unit used or intended to be used for living and sleeping, but not for cooking or eating purposes.
   (u)    "Rubbish, burnable" means combustible waste material except garbage, and includes paper, rags, cartons and boxes, wood, excelsior, rubber, leather, tree branches and yard trimmings.
   (v)    "Rubbish, nonburnable" means noncombustible waste materials such as ashes, glass, tin cans, metals, mineral matter, ceramics and junk.
   (w)   "Substandard" means a structure or dwelling unit which, by reason of physical defects, damage, neglect, or other conditions in potentially deleterious to the health or safety of persons using or occupying the same.
   (x)    "Supplied" means paid for, arranged, furnished or provided by or under control of the owner or operator.
   (y)   "Undefined words" means words not specifically defined in this chapter shall have the common definition set forth in a standard dictionary.
   (aa)   "Toxic substance" means any chemical product applied on the surface of or incorporated into any structure or decorative material which constitutes a potential hazard to human health at acute or chronic exposure levels.
   (bb)   "Vacant" means a structure or dwelling unit that has not been occupied for a continuous period of 180 days or more.
