   (B)   (1)   For any person, firm or corporation violating the terms of this schedule who chooses to prepay the administrative penalty, the rate shall not be less than ten dollars ($10.00).
      (2)   If violation of this schedule results in a uniform citation being issued, any person, firm or corporation who shall violate the provisions of this schedule shall be deemed guilty of a violation and shall be punished by a fine not less than ten dollars ($10.00) nor more than any stated amount provided in KRS 534.040 for a violation offense.
