ADOPTING ORDINANCES
ORDINANCE NO. 142-2000
AN ORDINANCE OF THE CITY OF ASHLAND, KENTUCKY, ADOPTING AND ENACTING THE CODE OF ORDINANCES, AMENDING, RESTATING, CODIFYING AND COMPILING THE CITY'S GENERAL ORDINANCES DEALING WITH THE SUBJECT MATTERS EMBRACED THEREIN.
   WHEREAS, the general ordinances of the City of Ashland ("City") are currently kept in ordinance books which are indexed by the year with a code book group such ordinance compiled on a five year basis, and
   WHEREAS, such ordinances are frequently amended and often deal with matters addressed in other ordinance and the ordinances of this body are easier found and dealt with by the codification of the City's ordinances as contemplated and authorized by the Kentucky General Assembly under the provisions of KRS 83A.060(5), and
   WHEREAS, it is the desire of the Board of City Commissioners to make its legislative acts readily accessible and to adopt those provisions of Kentucky Revised Statutes or nationally recognized standard codes contained therein;
   NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF ASHLAND, KENTUCKY:
   SECTION 1. The general ordinances of the City of Ashland, Kentucky as contained in the Code of Ordinances of the City of Ashland attached hereto and incorporated herein as if set out in full are hereby adopted, amended, revised, restated, codified and compiled in book form and shall constitute the "Code of Ordinances of the City of Ashland, Kentucky" ("the Code").
   SECTION 2. The Code as adopted herein shall consist of the following titles:
      Title I      General Provisions
      Title III   Administration
      Title V      Public Services
      Title VII   Traffic Code
      Title IX   General Regulations
      Title XI   Business Regulations
      Title XIII   General Offenses
      Title XV   Land Usage
      Index
   SECTION 3. There will continue to be ordinances which are adopted and not placed in the Code, but kept in separate annual ordinance books. These ordinances shall relate to individual matters or of a temporary or special nature which do not require reference to on a regular basis by the general public, court system and other relying upon the Code. This shall include, but not be limited to, annual budgets, contracts, deeds, right-of-way agreements and approval of signs. These ordinances shall be maintained in a manner compliant with the Kentucky Revised Statutes.
      SECTION 4. All prior ordinances pertaining to the subjects treated in said Code shall be deemed repealed from and after the effective date of this ordinance, except as they are included and reordained in whole or in part in the Code, provided such repeal shall not affect any offense committed or penalty incurred or any right established prior to the effective date of the Code, nor shall such repeal affect the provisions of ordinances levying taxes, appropriating and budgeting money, annexing or detaching territory, establishing franchises, or granting special rights to parties, authorizing public improvements, authorizing the issuances of bonds or borrowing money, authorizing the purchase of sale or real or personal property, granting or accepting easements, plat or dedication of land to public use, naming or vacating or setting boundaries of streets, alleys or other public places, nor to any other ordinance of a temporary or special nature or pertaining to subjects not contained therein. Further ordinances adopted by the Board after those which have been codified in the Code are excepted to any repeal.
      SECTION 5. Said Code shall be deemed published as of the day of its adoption and approval by the City Legislative Body and the Clerk of the City of Ashland is hereby authorized and ordered to file a copy of said Code in the Office of the City Clerk.
      SECTION 6. Said Code shall be in full force and effect two (2) weeks from the date of its publication and filing thereof in the Office of the Clerk, and said Code shall be presumptive evidence in all courts and places of the ordinance and all provisions, sections, penalties and regulations therein contained and of the date of passage, and that the same is properly signed, attested, recorded and approved and that any public hearings and notices thereof as required by law have been given.
