§ 97.042 PAVING CONTRACTS TO CONTAIN CERTAIN SPECIFICATIONS.
   (A)   All contractors engaged in street, alley, or sidewalk paving in the city, shall be required to notify the Department of Utilities in writing of their intention to excavate the street, alley, or sidewalk ten days in advance, so as to permit the Department of Utilities to locate for the contractor all water mains, service lines, and valve boxes. Stakes shall be driven by the Department of Utilities to locate these water mains, service lines, and valve boxes. After the mains and service lines have been uncovered by the contractor, the contractor shall give the Department of Utilities ample time to either lower the mains and service lines, or to remove them to another location.
   (B)   Any property of the Department of Utilities lost or damaged by or through the negligence of the contractor on making street or sidewalk excavations shall be replaced by the Department of Utilities at the contractor's expense.
   (C)   The provisions contained in divisions (A) and (B) above shall be inserted in all specifications for the paving of the streets, alleys, or sidewalks, and shall be considered a part of the contract for any paving hereafter let.
