§ 90.21 VICIOUS OR WILD ANIMALS.
   (A)   It shall be unlawful to possess or have custody of a vicious animal as defined within this subchapter within the city.
   (B)   No person shall own, possess, or have custody on his premises any wild or vicious animal for display, training or exhibition purposes, whether gratuitously or for a fee.
   (C)   No person shall keep or permit to be kept any wild animal as a pet.
   (D)   Such action shall constitute a violation of this provision by any person owning or having custody of such animal. However, if the animal in question has bitten or injured a human being or domesticated animal on a prior occasion which resulted in the citation of the owner or party in charge of the animal, then such person shall be charged with a Class A misdemeanor, and the animal, at the order of the court, shall be euthanized. If the owner or custodian of an animal has been previously convicted of having a vicious animal, such conviction shall be offered as prima facie evidence of the animal's viciousness. Nothing contained in the provision shall prevent prosecution of the owner or custodian of an animal which has committed an attack upon a human being which warrants prosecution under any applicable provisions of the Kentucky Penal Code for a felony.
