§ 130.99  PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
   (B)   Whoever violates § 130.01 of this chapter shall be fined as follows:
      (1)   First violation: $250, plus costs, which shall be paid and processed through the town’s Ordinance Violation Bureau;
      (2)   Second violation: in the event a second violation occurs within 90 consecutive days of the issuance of the first violation, the fine shall be $750, plus costs, which shall be paid through the County Prosecutor’s office and/or county courts in accordance with I.C. 33-36-2-3; and
      (3)   Additional violations: in the event there are any additional violation(s) within one year from the date of the issuance of the second violation, then the violator will be subject to a fine of $2,500, plus costs, with each day thereafter constituting a separate offense shall subject the violator to a separate fine of $2,500, plus costs, per day. Payment shall be paid through the County Prosecutor’s office and/or county courts in accordance with I.C. 33-36-2-3. If, after multiple violations by the same person or entity, the Town Attorney and/or the County Prosecutor’s office, and the town’s Police Department have reasons to believe that the imposition of fines will not be effective in enforcing this chapter, the Town Attorney and/or the County Prosecutor’s office shall be empowered to seek any other remedies provided by law.
   (C)   (1)   Any person, firm or corporation who violates any provision of § 130.02(A) of this chapter, or who undertakes, permits or allows an act or conduct prohibited herein, shall, upon conviction, be punished with a minimum fine of $25 and a maximum fine of $2,500, in addition to costs.
      (2)   In addition to the fine imposed by division (C)(1) above, a person, firm or corporation violating any provision of § 130.02(A) of this chapter shall be liable to the town for all expenses, losses or damages, including attorney fees and costs, sustained or caused by town in connection with the violation.

   (D)   Any person, firm or corporation who violates any provision of § 130.03 of this chapter shall, upon conviction, be punished with a minimum fine of $25 and a maximum fine of $2,500, in addition to costs. Each incident shall constitute a separate violation under § 130.03 of this chapter.

   (E)   Any child, parent, guardian or custodian who violates any provision of § 130.04 of this chapter shall, upon conviction, be punished with a minimum fine of $25 and the maximum fine of $250, in addition to costs. Each incident shall constitute a separate violation hereunder.

   (F)   Any person who violates any provision of § 130.05 of this chapter shall, upon conviction, be punished with a minimum fine of $10 and a maximum fine of $200, in addition to costs. Each incident shall constitute a separate violation under § 130.05 of this chapter.

   (G)   Any person violating any of the provisions of § 130.06 of this chapter shall be subject to a fine in an amount of $50 for the first violation, payable at the Town Hall. Any subsequent violation shall subject the violator to a fine of up to $2,500 per violation. In addition to any fine and court costs, violators shall reimburse the town for the cost of responding emergency services, if any.
