§ 112.99  PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
   (B)   (1)   Whoever shall violate or fail to comply with any of the provisions of §§ 112.01 through 112.06 of this chapter or shall violate or fail to comply with any order or regulation made hereunder shall be fined not less than $5, nor more than $1,000. The payment of such a penalty shall not excuse the violation or permit it to continue, nor shall such payment be held to prevent the enforced correction of the prohibited conditions by legal and injunctive remedies. A separate offense shall be deemed committed upon each day during or on which such violation occurs or continues.
      (2)   In addition to the other penalties and remedies provided herein and pursuant to the authority granted the town under I.C. 36-1-6-2 and 36-1-6-4, the Marshal and other officers and employees of the town may enter onto real property where a condition violating any term or condition of §§ 112.01 through 112.06 of this chapter exists and take appropriate action to bring the property into compliance with §§ 112.01 through 112.06 of this chapter; provided, however, before action to bring compliance may be taken, all persons holding a substantial interest in the property must be given a reasonable opportunity to bring the property into compliance with §§ 112.01 through 112.06 of this chapter. If action to bring compliance is taken by the town, the expenses involved shall be made a lien against the property.

   (C)   (1)   Whoever shall violate or fail to comply with any of the provisions of §§ 112.20 through 112.22 of this chapter, or shall violate or fail to comply with any order or regulation made hereunder, shall be fined not less than $5, nor more than $1,000. The payment of a fine shall not excuse the violation or permit it to continue, nor shall such payment be held to prevent the enforced correction of the prohibited conditions by legal and injunctive remedies. A separate offense shall be deemed committed upon each day during or on which such violation occurs or continues.
      (2)   In addition to the other penalties and remedies provided herein and pursuant to the authority granted the town under I.C. 36-1-6-2 and 36-1-6-4, the Marshal and other officers and employees of the town may enter onto real property where a condition violating any term or condition of §§ 112.20 through 112.22 of this chapter exists and take appropriate action to bring the property into compliance with §§ 112.20 through 112.22 of this chapter; provided, however, before action to bring compliance may be taken, all persons holding a substantial interest in the property must be given a reasonable opportunity to bring the property into compliance with §§ 112.20 through 112.22 of this chapter. If action to bring compliance is taken by the town, the expenses involved may be made a lien against the property.
