§ 92.04  LITTER; RECEPTACLES TO PREVENT SCATTERING.
   (A)   Persons placing litter in public receptacles or in authorized private receptacles shall do so in such a manner as to prevent it from being carried or deposited by the elements upon any street, sidewalk or other public place, or upon private property.
   (B)   No person shall place a container in or in proximity to a public right of way or public area except for collection as provided herein. Receptacles shall be placed so as to be readily accessible for collection. Receptacles shall not be placed for collection earlier than 5:00 p.m. the day before collection and shall be removed from the proximity of the public right of way or public area by 8:00 p.m. the day of collection. At all other times any receptacles that are kept outside of structures on a property shall comply with one of the following: (1) be kept a minimum of 25 feet from the edge of the pavement of the nearest public street, or (2) be kept within two feet of the residence or garage located on the property. No person shall allow trash, debris, refuse or yard waste to accumulate on his or her property.
   (C)   No person shall open burn any material, except wood products. WOOD PRODUCTS means materials derived from or consisting of wood or vegetation such as paper, cardboard, rags, boards, branches, brush, grass, leaves and other similar materials. All open burning shall occur during daylight hours, and said burning shall be attended at all times until completely extinguished by a responsible person. All of the burning materials must be consumed by sunset. No burning shall be conducted during unfavorable meteorological conditions such as temperature inversions, high winds, air stagnation and the like. If the fire creates an air pollution problem, a nuisance or a fire hazard, it shall be extinguished immediately. Any burning of material of all types shall be done in adequate containers, which will prevent the materials and ashes from scattering upon public and private property, including the property upon which the burning is taking place.
