§ 91.05 FIREWORKS.
   (A)   Unlawful sale and possession of fireworks. It shall be unlawful for any person, firm, partnership, or corporation to offer for sale or to possess any fireworks within the corporate limits of the town at any time during the year except as allowed by § 91.05(B).

   (B)   Unlawful use of fireworks. It shall be unlawful for any person, firm, partnership, or corporation to discharge, ignite, or use fireworks within the corporate limits of the town except on July 4 between the hours of 8:00 a.m. and 12:00 p.m. (midnight); provided, no fireworks shall be used at any time within the fire zone of the town or within 300 feet of any hospital, church, public meeting place, or flammable agricultural crop.

   (C)   Definition. The term FIREWORKS shall mean and include any composition or device for the purpose of producing a visible or an audible effect by combustion, explosion, deflagration, or detonation and which is defined as common or special fireworks by the United States Department of Transportation (DOT). The term FIREWORKS shall not include toy cap pistols and caps, blank cartridges, railroad flares, and model rockets.
