§ 9-5.2001 SWIMMING POOLS AND HOT TUBS.
   (A)   Any swimming pool or other out-of-doors body of water designed, constructed, or used for swimming, dipping, or immersion purposes by men, women, or children, having any depth in excess of 18 inches, or with a surface area exceeding 250 square feet, shall have on the lot or premises upon which such pool or body of water is located, and completely surrounding such pool or body of water, a fence or wall not less than six feet in height with openings not to exceed the maximum allowed by the Uniform Building Code; provided, however, a dwelling house or an accessory building may be used as a part of such enclosure.
   (B)   All gates or doors opening through the enclosure required in division (A) of this shall be equipped with self-closing and self-latching devices designed to keep, and capable of keeping, such doors or gates securely closed at all times when not in actual use. Where a dwelling occupied by human beings forms any part of the enclosure required in division (A) of this section the doors of such dwelling need not be so equipped. Doors or gates of breezeways, rear doors of garages, and similar structures which afford access to a swimming pool shall not be construed to be included within a dwelling and shall be provided with such self-closing and self-latching devices. Such latching devices shall be placed not less than four feet above the floor or ground level.
   (C)   No swimming pool shall be constructed so that any portion thereof shall be closer than five feet to any interior side or rear lot line, nor within 10 feet of any exterior side lot line. Filter and heating systems shall be located no closer than 10 feet to any dwelling other than that of the owner. In single-family residential districts, swimming pools shall be located on the rear half of the lot or at least 50 feet from the front property line. In cases where the lot shape is irregular and a side yard functions as the primary outdoor living area, a swimming pool may be allowed in that side yard provided it is behind the front building line of the home. In the R-10, R-15, and R-20 Districts swimming pools may be located within the front half of the lot or within 50 feet of the front property line provided a use permit shall be secured.
   (D)   Any swimming pool or other body of water for which an enclosure is required, shall be so located that the edge thereof shall be not less than five feet from the required enclosure.
