§ 12-3-107. Passengers in unenclosed areas of motor vehicles.
   (a)   Definitions. In this section, the following words have the meanings indicated:
      (1)   "Motor vehicle" means a Class A motor vehicle as defined in the Transportation Article, § 13-912, of the State Code, a Class E motor vehicle as defined in the Transportation Article, § 13-916, of the State Code, and a Class M motor vehicle as defined in the Transportation Article, § 13-937, of the State Code.
      (2)   "Seat belt" means a seat belt as defined in the Transportation Article, § 22-412, of the State Code.
   (b)   Prohibitions. A person may not ride or allow another person to ride in the unenclosed area of a motor vehicle except in a seat and with a seat belt in use. A person may not allow a dog to ride in the unenclosed area of a motor vehicle unless the animal is confined by a securely affixed, well-ventilated container, cage, or other device designed to safely prevent the animal from falling or jumping from the motor vehicle.
   (c)   Sanction for violation. A violation of this section is punishable by a fine of $50.
