§ 6-2-104. Court and State's Attorney employees' pay and benefit plan.
   (a)   Applicability. This section applies to those employees in the exempt service who are appointed by and with the approval of the judges of the Circuit Court for the County or the State’s Attorney for the County.
   (b)   Pay plan.
      (1)   The Personnel Officer shall formulate and maintain a pay plan for positions in the exempt service to which employees are appointed by the judges of the Circuit Court for the County or the State’s Attorney for the County, which shall include job titles, pay grades, and pay scales.
      (2)   Authority for changing pay grades or titles shall be based on appropriations.
      (3)   The non-represented employee pay schedule is used to set pay levels only and confers no merit system rights on the officers and employees of the Circuit Court and State’s Attorney.
   (c)   Approval. The pay plan shall be approved annually by ordinance of the County Council.
   (d)   Posting. The pay plan shall be posted on the County website and available to County employees and the public.
   (e)   Pay upon initial hiring. Except as otherwise provided in this subsection, an employee shall be hired at the minimum pay of the grade. On finding and certifying in writing that extraordinary circumstances exist, the appointing authority may hire the employee at a pay within the grade if there are sufficient appropriations available.
   (f)   Employment benefits. Employees are entitled to all employment benefits applicable to classified employees provided sufficient appropriations exist.
