717.06 APPLICATIONS FOR LICENSE.
   (a)   Application for the license required by this chapter shall be made to the Building Department on forms prescribed by the Law Director.
   (b)   All applications shall be signed by the owner or owners, including all partners in the case of a partnership, all officers and directors in the case of a corporation, and all officers and managers in the case of a limited liability company.
   (c)   In the event no person owns twenty-five percent (25%) or more of the sweepstakes terminal café, such application shall be signed by an authorized representative of the sweepstakes terminal café.
   (d)   All applications shall contain a statement that the information contained in the application is complete, accurate and truthful to the best knowledge of all applicants.
   (e)   Every owner and operator of the sweepstakes terminal café shall be fingerprinted by the Amherst Police Department, Lorain County Sheriff's Department or other law enforcement agency in a manner sufficient to facilitate a national background check of such owners and operators. The costs associated with obtaining the fingerprints of the owners and operators shall be borne by those owners and operators.
   (f)   All applications shall include the following:
      (1)   Name and home address (no post office boxes), age and birth date of each owner;
      (2)   Business and home telephone numbers of each owner;
      (3)   Employment history of each owner for the past five years;
      (4)   A statement as to each owner as to whether the owner has been convicted of any crime other than traffic offenses and, if so, the date and place of conviction, the nature of the offense and the penalty imposed;
      (5)   A statement as to whether any owner has ever conducted a sweepstakes terminal café and, if so, when, where and for how long;
      (6)   A description of the nature and operation of the main type of business activity to be conducted upon the premises for which the license is sought;
      (7)   A description of the nature and operation of any business to be conducted in conjunction with the sweepstakes terminal café;
      (8)   The address (no post office boxes) and telephone number of the premises for which the license is sought, and of the business if different from the premises;
      (9)   A statement as to whether the owner(s) will directly operate the sweepstakes terminal café or whether or not an operator who is not an owner will operate it and, if the latter, the application shall contain information required by this section supplied in detail as to each such operator;
      (10)   The number and location of off-street non-public parking spaces for the premises which number shall not be less than the number of parking spaces required in Section 717.09(c);
      (11)   The name, address and telephone number of the agent of the business upon whom service of process can effectively and validly be made;
      (12)   The number, type, name, model and manufacturer's serial number of each computerized sweepstakes device to be located at the premises;
      (13)   A description of the nature and type of property or services which will be sold or supplied on the premises;
      (14)   A copy of the title or lease to the premises;
      (15)   A copy of the articles of incorporation, if the owner is a corporation;
      (16)   A copy of the articles of organization and a copy of the operating agreement, if the owner is a limited liability company;
      (17)   A copy of the partnership agreement, if the owner is a partnership;
      (18)   Specification of the days of the week and the hours of the day during which the licensed activity will be conducted;
      (19)   Documentation from a Certified Independent Regulatory Compliance Testing Laboratory that each computerized sweepstakes device to be placed in service at the premises performs in similar fashion as other permitted sweepstakes commercially offered to the public and the entries are drawn from a pre-created finite static pool of entries with assigned values. To be certified, the Independent Regulatory Compliance Testing Laboratory must be authorized to test regulated gaming equipment by at least one state government gaming regulatory agency;
      (20)   Any other information or documentation as may be deemed reasonably and specified on the application form; and
      (21)   The name and address of each owner, if not the applicant, of any computerized sweepstakes device to be located on the premises, and copies of any lease or other agreements for such devices pursuant to which applicant has possession of them.
