The Director of Public Safety and Service and Police Chief shall not recommend the issuance or renew a sweepstakes terminal café license for any business or premises:
(a) Where the premises are located in any zoning district in the City that does not allow such business;
(b) Where any of the owners or operators have been convicted within the last five years of any felony, a misdemeanor involving minors, or a misdemeanor involving any gambling activity;
(c) Where the premises do not provide a minimum of one off-street non-public parking space for every two computerized sweepstake devices;
(d) Where it is determined that the premises or operation would be in violation of any applicable provision of the Building Code, the Zoning Code or any other applicable provision of local, state or federal law;
(e) Where the applicant made a false statement as to a material matter on the application or in a hearing concerning the license;
(f) Where the application failed to provide all the required information; or
(g) Where the owner, operator and/or applicant fails to comply with all terms and conditions under this chapter and all other applicable ordinances, laws, rules or regulations.
