145.02 AUTHORITY OF CHIEF.
   (a)   The Fire Chief shall have exclusive control of the stationing and transferring of all firemen and other officers and employees in the Division of Fire under such general rules and regulations as the Director of Public Safety prescribes.
   (b)   The Fire Chief, if so qualified pursuant to the level of training established under the City of Amherst Fire Department Special Programs, Procedure Fire and Arson Investigation protocols, and if certified as a Fire Safety Inspector pursuant to Ohio R.C. 3737.34, shall be authorized to perform the duties established at the level of training as aforesaid in the capacity of Fire Investigator. The Chief may administer oaths, issue citations, make arrests, and enter, for the purpose of examination, any building which, in the Chief's opinion, is in danger of fire as provided in Ohio R.C. 737.27 pursuant to the authority granted by this section.
   (c)   If so qualified by the Amherst Police Department in accordance with all Ohio Peace Officer Training mandates, the Amherst Fire Department Safety/Firearms Policy and state law, the Fire Chief may possess, carry, and use a firearm in his capacity as Chief. The Chief shall maintain firearm training comparable to or in concert with training required by the Amherst Police Department.
