§ 44-49. SPECIAL CONTRACTS FOR SALE OF WATER.
   (A)   The Mayor of the city, subject to approval of the City Council, is hereby authorized to enter into a contract with any person residing or located outside the corporate limits of the city to sell and furnish to such person, from its water supply, such surplus water as is not immediately required by the city or its inhabitants.
   (B)   Such contract shall:
      (1)   Be in writing;
      (2)   Be signed by the person to whom or to which such water is furnished;
      (3)   Be conditioned that the person entering into such contract shall pay all expenses of making connection and shall furnish all materials and labor necessary at his or her own expense;
      (4)   Provide that the city shall not furnish or construct any pipelines or conduits beyond the corporate limits of the city;
      (5)   Be conditioned that the city shall furnish such water only from its surplus supply and only water as is not immediately required for the use of the city or its inhabitants;
      (6)   Expressly state that such contract may be abrogated by the city at any time the Mayor and City Council shall, by resolution duly adopted, declare such water so being furnished under such contract is required by the city for its own use and the use of its inhabitants; and
      (7)   Contain such other provisions as the Mayor and Council shall deem necessary and proper to protect the interest of the city and its inhabitants.
