§ 40-106. CUTTING AND PATCHING OF STREETS AND ALLEYS.
   (A)   It is unlawful to cut or trench any street or alley without first obtaining a permit to do so.
   (B)   The permit fee shall be in an amount on file in the City Clerk’s office, plus the contractor must post a bond in an amount on file in the City Clerk’s office with the city at the time the contractor obtains the permit.
   (C)   The street or alley must be patched within seven days after excavation, or the city will patch it and the bond will be forfeited.
   (D)   Patching procedure:
      (1)   Pavement must be sawed to form straight edges, and to allow a minimum of six inches of undisturbed soil on each side of the trench;
      (2)   The trench must be backfilled with fill sand and compacted as it is being filled;
      (3)   The concrete will be six inches thick and will be “High Early” (eight sack mix);
      (4)   Before placing the concrete, the contractor shall call the Street Superintendent or the City Building Inspector for inspection; and
      (5)   For unpaved streets and alleys, backfill will be the same material which was removed and will be compacted as it is being placed into the trench or will be settled by flooding with water. The contractor shall be responsible for checking the excavations site after seven days and adding any fill to bring the site back to grade.
   (E)   The contractor will be responsible to barricade the site, in such a manner as to not endanger the public, from the time of excavation until the concrete has obtained the strength to support traffic (approximately three to five days).
