§ 38-52. FISHING REGULATIONS, REQUIREMENTS, RESTRICTIONS, AND EXCEPTIONS AT HATFIELD PARK POND AND OTHER LAKES OR PONDS OWNED OR OPERATED BY THE CITY.
   (A)   Except as modified herein, all state fishing regulations, including, but not limited to, permit and license requirements, shall be in effect at the Hatfield Park Pond and other lakes or ponds owned or operated by the city.
   (B)   All persons fishing at the Hatfield Park Pond, or other lakes or ponds owned or operated by the city, shall have a valid state fishing license, unless exempt, and shall obey all state fishing regulations.
   (C)   Fishing is limited to not more than two rods and reels, per person, with no more than three hooks per line (treble hooks are considered one hook). All other fishing methods are prohibited.
   (D)   No trotlines, throwlines, limblines, juglines, or yo-yos shall be permitted.
   (E)   No snagging, seining, netting, cast netting, trawl nets, hand nets, spearing, gigging, grabhooking, or noodling (hand fishing) shall be permitted. Bow fishing is prohibited.
   (F)   There shall be no introduction of fish to any pond or lake owned or operated by the city, by the public, or any source other than those approved by the State Department of Wildlife Conservation and the city.
   (G)   No person shall deposit unused bait of any character, including, but not limited to, minnows, small fish, worms, flesh of animals, or any other deleterious matter which might decay in the waters of any city owned or operated pond or lake, or upon the lands adjacent thereto.
   (H)   Fishing shall be from the banks and fishing piers only. The use of flotation devices, including float tubes, canoes, row boats, and other similar flotation devices powered by electric motor, oars, paddles, or other human powered means are specifically prohibited.
   (I)   Swimming is prohibited at any city owned or operated pond or lake.
   (J)   Until April 30, 2013, all fish caught must be returned to the water immediately (catch and release). Effective May 1, 2013, the following daily fishing limits shall apply.

   (K)   All fish caught must be returned to the water immediately or they will count as part of the daily limits.
   (L)   Any member of the Alva Police Department may issue a citation to any person who has violated this section of the law, and may require such person to immediately vacate the premises, or may arrest any person who has violated this section, or refuses to vacate the premises as ordered, without warrant, and the Municipal Court shall have jurisdiction of all such violations.
   (M)   State game rangers and other representatives of the State Department of Wildlife Conservation with enforcement powers are authorized to enforce any regulations contained herein, and all other applicable state fishing regulations.
   (N)   Violation of this section of the code shall be a misdemeanor and, upon conviction, punishable by a fine of not more than $100, and costs.
