§ 10-91. MECHANICAL CONTRACTOR CITY REGISTRATION.
   (A)   (1)   It is unlawful for any person to engage in mechanical work as defined in subsections (A)(1) through (A)(4) below of this section, within the city limits unless he or she is registered with the city office and has a current and valid certificate of registration.
      (2)   For the purpose of this section, the following definitions apply unless the context clearly indicates or requires a different meaning.
         GAS PIPING. All natural gas piping within or adjacent to any building, structure, or conveyance on the premises up to the connection with a natural gas meter, regulator, or other source of supply.
         GROUND SOURCE PIPING. Piping buried below the earth’s surface or submerged in a water well, lake, or pond and used in conjunction with a heat pump to provide heating, ventilation, and/or air conditioning to a structure.
         HVAC or HEATING, VENTILATION, AND AIR CONDITION. The process of treating air by controlling its temperature, humidity, and cleanliness and of supplying such air to spaces for human occupancy by means of an integrated system or air conditioning and ventilation equipment, accessories, and control devices.
         MECHANICAL WORK. The installation, maintenance, repair, or renovation, in whole or in part, of any heating system, cooling system, mechanical refrigeration system, or ventilation system, or any equipment or piping carrying chilled water, air for ventilation purposes, or natural gas, or the installation, maintenance, repair, or renovation of process piping used to carry any liquid, substance, or material, including steam and hot water used for space heating purposes not under the jurisdiction of the Department of Labor, provided that minor maintenance and repairs are excluded.
         REFRIGERATION SYSTEM. A system employing fluid which normally is vaporized and liquified in an air conditioning system, food preservation measure, or manufacturing process.
         SHEET METAL. The ferrous and non-ferrous ductwork and components which house and ventilate air conditioning systems, both assembled and custom fabricated.
   (B)   Only a person who has a current and valid license as a mechanical contractor issued by the state’s Construction Industries Board may register as such with the city.
   (C)   Upon application to the city, the applicant shall give full name, residence address, and place of business address, and in case of removal from one place to another, shall make a corresponding change in the register accordingly and the payment of the required fee to the City Clerk’s office. The city shall register such applicants and issue to them certificates of registration.
   (D)   City certificates shall not be valid after the termination or expiration of state licenses or certificates. Registration certificates of mechanical contractors issued as provided herein shall expire after one year from date of issuance.
   (E)   For all certificates of registration authorized by this section there shall be charged and collected the following fees: Mechanical contractor: $100 for the initial year and a $50 per year renewal fee thereafter (if not renewed within one year, renewal will be $100).
   (F)   A mechanical contractor must provide the name and license number of each worker employed by contractor as a mechanical journeyman or a mechanical apprentice.
   (G)   Any violation of any provision contained in this section is an offense against the city; upon conviction of any such offense, the violator shall be punished by a fine as follows:
      (1)   First offense: $200; and
      (2)   Second and subsequent offenses: $300.
