§ 40.70. EASEMENTS AND DEDICATIONS FOR PUBLIC USE.
   (A)   Easements and dedications in general. No dedication for a drainage easement or a street or other public use shall be shown on a plat unless the City Council determines to accept such dedication.

   (B)   Easements: drainage. When a subdivision is traversed by a watercourse, drainage way, channel, stream, or creek, the subdivider shall provide a storm water easement or drainage right-of-way of sufficient width for such purpose and for maintenance, wherever the Planning Commission finds such easement desirable.

   (C)   Easements: utility. Where alleys are not provided or may not be used for that purpose, easements not less than seven and one-half feet in width shall be provided at the rear of each lot for poles, wires, conduits, storm sewers, sanitary sewers, gas lines, water mains and lines, and other utility purposes. In no case shall the combined widths of the easements on both sides of a rear lot line be less than 15 feet. Additional easements shall be provided where required by the Planning Commission.
