§ 20.30. PLANNING COMMISSION ACTION ON PRELIMINARY PLAT.
   (A)   When subdivider submits both preliminary plat and improvement plans.
      (1)   After the subdivider submits to the Planning Commission the preliminary plat, preliminary plat checklist, and improvement plans, the Planning Commission shall, within 45 days, approve, approve conditionally, or disapprove the plat and plans, but any approval shall be revocable.
      (2)   If the Planning Commission finds that said plat and improvement plans meet all the requirements of these regulations, it shall approve the preliminary plat and improvement plans by placing a stamp of approval upon each copy of said plat and plans. Such stamp of approval shall bear the signature of the Chair and Secretary of the Planning Commission and shall provide that the approval given thereby does not constitute approval for purposes of recording.
      (3)   If the preliminary plat is disapproved or approved conditionally, the reasons for such action shall be stated in writing, a copy of which, signed by the Chair of the Planning Commission, shall be attached to one copy of the plat and transmitted to the subdivider. The reasons for disapproval or conditional approval shall refer specifically to those parts of these regulations or the Comprehensive Plan with which the plat does not conform. On conditionally approving a plat, the Planning Commission may require submission of a revised preliminary plat, which shall be processed in the same manner as an original preliminary plat.
      (4)   If no action is taken by the Planning Commission within the stated time, the plat shall be deemed to have been approved by the Planning Commission.

   (B)   When subdivider presents only the preliminary plat. Whenever the subdivider presents to the Planning Commission a preliminary plat and preliminary plat checklist, without improvement plans, the Planning Commission may conditionally approve the preliminary plat, subject to Planning Commission approval of the improvement plans, within 90 days following the preliminary plat approval.
