(A) Building permit issued. If, before the effective date of this appendix or amendment thereof, a building permit authorizing construction was lawfully issued, such construction may be started or continued after such date, subject to the provisions of § 70.70.

(B) Annexed territory. If the city annexes land where construction of a structure has started and such construction does not conform to this appendix, construction of that structure may be continued. For the purposes of this section, construction shall be deemed to have been started if the Board of Adjustment finds, on application, that as of the date of annexation the foundations had been completed or costs equaling 5% of the total estimated construction cost had been incurred and would be lost if construction were not permitted to proceed.
