If at any time any excavating, grading, regrading, landfilling, berming or diking of any property within the city is performed which is not in accordance with this chapter or an earth contour change permit, including conditions attached hereto and approved modifications thereof, a written notice to comply shall be given, stating the location, the nature of the alleged noncompliance and such time as may be deemed reasonable to correct the noncompliance, determined according to the nature of the deficiency and whether or not it creates a nuisance or a hazard. If in the judgment of the public works director, any such noncompliance has not been corrected within a reasonable time or any condition exists or any act is done which constitutes or creates a hazard endangering human life or property of others, he shall suspend any permit which may have been issued and issue a stop work order. The city may institute actions or proceedings at law or in equity for the enforcement of the provisions of this chapter. (Ord. 6169, 7-23-1997)
