9-5-3: CONDITIONS FOR ISSUANCE:
Prior to granting any earth contour change permit, the public works director shall attach such conditions thereto as are necessary to prevent any determent to the public or private lands or to persons and to prevent the work thereby authorized from being conducted in a manner detrimental to life or property or otherwise likely to create a public nuisance. Such conditions may include, but are not limited to, the following:
   A.   Conformity to and compliance with the subdivision code, including, but not limited to, compliance with section 12-4-9 of this code, relating to storm water management.
   B.   Compliance with phase II of the United States EPA storm water regulations as adopted by the city of Alton with the notice of intent to comply with the EPA regulations filed on or before March 10, 2003.
   C.   A site plan showing specific finished grade land contours indicating that the site will be left in a viable state for future development.
   D.   Boring logs, or pothole depth checks, showing that sufficient soil will remain after final grading to facilities the installation of public utilities, such as water and sewer.
   E.   Compliance with the applicable portions of section 200 of the state of Illinois standard specification for road and bridge construction; specifically including, but not limited to, articles 202.03, 202.05, 204.01, 204.02 pertaining to clearing, drainage and borrow pits.
   F.   No permit will be issued for the removal of soil, when the removal will result in a pond or lake, unless specifically shown as a feature of a development as shown on the submitted site plan.
   G.   An erosion control plan for the project shall be submitted for review and approval by the public works director or his appointed designee and shall include a performance bond equal to five percent (5%) of the estimated project cost or five thousand dollars ($5,000.00), whichever is the lesser.
   H.   The necessary public easements and rights of way.
   I.   A specific method for performing the work as authorized, and a sufficient surety bond or letter of credit or cash escrow approved by the public works director guaranteeing completion of the work as authorized. (Ord. 6729, 4-23-2003)
