9-2-11: MINIMUM STANDARDS FOR BASIC EQUIPMENT AND FACILITIES:
No person shall occupy as owner-occupant, or let to another for occupancy any dwelling or dwelling unit, for the purpose of living, sleeping, cooking or eating therein, which does not comply with the following requirements:
   A.   Every dwelling unit shall have a room or portion of a room in which food may be prepared and/or cooked, which shall have adequate circulation area, and which shall be equipped with the following:
      1.   A kitchen sink in good working condition and properly connected to a water supply system of the city which provides at all times an adequate amount of heated and unheated running water under pressure, and which is connected to a sewer system approved by the appropriate authority.
      2.   Cabinets and/or shelves for the storage of eating, drinking and cooking equipment and utensils and of food that does not under ordinary summer conditions require refrigeration for safekeeping; and a counter or table for food preparation; said cabinets and/or shelves and counter or table shall be adequate for the permissible occupancy of the dwelling unit and shall be constructed with surfaces that will not impart any toxic or deleterious effect to food.
      3.   Sufficient space for a stove or similar device, for cooking food, and a refrigerator, or similar device for the safe storage of food at temperatures less than fifty degrees Fahrenheit (50°F) but more than thirty two degrees Fahrenheit (32°F) under ordinary maximum summer conditions, which are installed with all necessary connections for safe, sanitary and efficient operation.
   B.   Within every dwelling unit there shall be a nonhabitable room which affords privacy to a person within said room and which is equipped with a flush water closet in good working condition. Said flush water closet shall be equipped with cleanable surfaces, be connected to a water system that at all times provides an amount of running water under adequate pressure to cause the water closet to be operated properly, and shall be connected to a sewer system which is approved by the appropriate authority.
   C.   Within every dwelling unit there shall be a lavatory sink. Said lavatory sink may be in the same room as the flush water closet, or if located in another room, the lavatory sink shall be located in close proximity to the door leading directly into the room in which said water closet is located. The lavatory sink shall be in good working condition and properly connected to a water supply system of the City of Alton Water Company, and which provides at all times heated and unheated running water under adequate pressure, and which is connected to a sewer system approved by the appropriate authority.
   D.   Within every dwelling unit there shall be a room which affords privacy within said room and which is equipped with a bathtub or shower in good working condition. Said bathtub or shower may be in the same room as the flush water closet or in another room and shall be properly connected to a water supply system which is approved by the appropriate authority and which provides at all times an adequate amount of heated and unheated water under adequate pressure, and which is connected to a sewer system approved by the appropriate authority.
   E.   Every dwelling shall have supplied water heating facilities which are properly installed and connected with the hot water lines required under subsection D of this section, and are capable of heating water to such a temperature as to permit an adequate amount of water to be drawn at every required kitchen sink, lavatory basin, tub or shower at a temperature of not less than one hundred twenty degrees Fahrenheit (120°F).
   F.   The owners of every dwelling unit shall supply each dwelling unit with adequate rubbish containers, the type and location of which are approved by the deputy director. (Ord. 4267, 1-11-1978; amd. Ord. 4356, 10-11-1978)
   G.   The occupants of not more than two (2) dwelling units may share a single flush water closet, a single lavatory basin and a single bathtub or shower if:
      1.   Neither of the two (2) dwelling units contains more than two (2) rooms; provided, that for the purposes of this subsection G, a kitchenette or an efficiency kitchen with not more than sixty (60) square feet of floor area shall not be counted as a room; and
      2.   The habitable area of such dwelling units shall equal not more than two hundred fifty (250) square feet of floor area; and
      3.   Such water closet, lavatory basin and bathtub or shower shall be in good working condition and properly connected to a water and sewer system; and
      4.   Such facilities shall be in the same building in which sleeping units are located and shall be conveniently accessible to the tenants, but shall not be in any habitable room.
   H.   Every dwelling shall have approved dual means of egress. Every dwelling unit in a multiple dwelling shall have immediate access to means of egress as required by the laws of the state and the city. Dual means of egress shall be interpreted to permit one operable window as one exitway and shall require not less than one doorway as an exitway.
   I.   Access to or egress from each dwelling unit shall be provided without passing through any other dwelling or dwelling unit. (Ord. 4267, 1-11-1978; amd. Ord. 4356, 10-11-1978)
   J.   The owners and the occupants of every dwelling unit (as defined in the carbon monoxide alarm detector act) shall comply with the provisions of the carbon monoxide alarm detector act of the state of Illinois approved by public act 94-741, effective January 1, 2007, now found in 430 Illinois Compiled Statutes 135/1. In the event the Illinois legislature shall amend the carbon monoxide alarm detector act, it is the intent of this section that the owners or occupants of any dwelling unit shall continue to comply with the carbon monoxide alarm detector act of the state of Illinois, as it may be amended from time to time.
