9-2-3: AUTHORITY TO INSPECT DWELLINGS, DWELLING UNITS, ACCESSORY STRUCTURES AND PREMISES:
The Deputy Director is hereby authorized and directed to make inspections to determine the condition of dwellings, dwelling units, rooming units and premises located within the City in order that they may perform their duty of safeguarding the health and safety of the occupants of dwellings and of the general public. For the purpose of making such inspections the Deputy Director is hereby authorized to enter, examine and survey at all reasonable times all dwellings, dwelling units, rooming units and premises. In the event the owner or occupant of any dwelling, dwelling unit or rooming unit or the person in charge thereof, refuses to give the Deputy Director free access to such dwelling, dwelling unit or rooming unit and its premises, at any reasonable time for the purpose of such inspection, examination and survey, then, and in that event, the Deputy Director may apply for a search warrant for such inspection from a court of competent jurisdiction when it is reasonably believed and probable cause exists that any provision of this Chapter is being violated.
