B. Permit Required: Prior to any proposed and necessary excavation, disturbance or disruption of the present brick streets and alleys set forth in this section by any person or corporation, a permit for such must be obtained from the appropriate department of the City, which permit shall detail the work to be allowed and shall contain an agreement and acceptance plan by the permittee to restore and replace the brick in the exact condition, pattern, and manner as existed at the time permit was issued; that the requirements of this section shall also apply to any utility operating in the city under franchise agreement.
C. Restoration:
1. Upon completion of any excavation, disturbance, or disrnption previously authorized by permit as provide herein, permittee shall restore the brick street or alley to their originally constructed state as existed at the time of and prior to the time pennit was given.
2. Any vitrified bricks displaced by public utilities and contractors through their repair efforts on brick streets which are not included on the brick street preservation list, heretofore itemized or on paved streets with an underlying brick street base, shall be delivered by the public utility to the City Street Maintenance Department upon completion of each repair and that security for the bricks shall be responsibility of the public utility and/or contractor, until such time as they are delivered to the City Street Maintenance Department. Failure to comply with this section shall result in a penalty payable to the City which is the forfeiture of the bond for the job or the cost of replacing the bricks, whichever is greater.
D. Repairs: Brick streets and alleys may only be repaired with vitrified street brick. If the bricks in Adams Court, West 15th, or that portion of West 13th south of 222 West 13th are removed by the City or its contractors, they may not be discarded but may only be used to repair the brick streets set forth in this section. The City may only pave the brick portion of Adams Court, W 15th or West 13th south of 222 West 13th if it removes the bricks first. E. Variance from Regulations: Any variance from regulations and provisions of this section shall be allowed only by action of City Council.
E. If previously unidentified, covered brick streets are identified, the City of Alton City Council shall be notified and approve whether the unidentified, covered brick street be preserved to its original state and added to Section 6-1-5(A).
