4-4-11: LOCATION RESTRICTIONS:
   A.   Zoning Districts:
      1.   No Class A license shall be issued for the sale of alcoholic liquor at retail on any premises zoned residential (R-1, R-2, R-3 or R-4) pursuant to the Alton zoning ordinance 1 .
      2.   No Class A license shall be issued for the sale of alcoholic liquor at retail on any premises not adjoined on all sides by premises zoned C or M pursuant to the Alton zoning ordinance. (Ord. 4935, 7-24-1985)
   B.   Proximity To Other Uses: No license shall be issued for sale at retail of any alcoholic liquor within two hundred feet (200') of the nearest part of any buildings used as a church, school, hospital, Young Men's Christian Association, Young Women's Christian Association, home for the aged or indigent persons or veterans, their wives or children or any military or naval station. Said two hundred feet (200') shall be measured from the nearest part of the building for which the retail liquor license is issued to the nearest part of the buildings of the respective institutions enumerated above. Provided, however, that this prohibition shall not apply to the renewal of a license for the sale at retail of alcoholic liquor at hotels offering restaurant service, regularly organized clubs or to restaurants, food shops or other places where sale of alcoholic liquors is not the principal business carried on, if the church, school, hospital, Young Men's Christian Association, Young Women's Christian Association, home for the aged or indigent persons or veterans, their wives or children, or any military or naval station has been established within such two hundred feet (200') since the issuance of the original liquor license.
      1.   Notwithstanding the foregoing, a Class D liquor license may be issued to a qualified licensee for the location commonly known as the old Post Office building on the northwest corner of the intersection of Third Street and Alby Street in the City of Alton, Illinois. (Ord. 6935, 2-8-2006)
      2.   Notwithstanding the foregoing, a Class E liquor license may be issued to a qualified licensee for the location commonly known as the Honke Building on the northeast corner of the intersection of Third Street and Henry Street in the City of Alton, Illinois. (Ord. 7000, 4-25-2007)
      3.   Notwithstanding the foregoing, a liquor license may be issued to a qualified licensee if the licensee can produce written evidence that the church, school, hospital or other protected entity located within two hundred feet (200') of the proposed location of the licensed premises has granted consent that a particular class of liquor license may issue to that particular location. Any consent given shall be valid for one year from the date of the execution of the consent or until revoked in writing by the entity which gave the consent delivered to the Office of the Local Liquor Control Commissioner, whichever shall first occur. Once a liquor license has been granted for the particular location to be licensed, that consent may not be thereafter revoked, unless no liquor license is in effect for that particular location for a continuous period of three (3) years or more, in which case the previously granted consent shall be considered null and void and a subsequent applicant for a particular class of liquor license at that location shall be required to obtain new consents as required by this chapter.    C.   Change Of Location: Any license issued hereunder shall permit the sale of alcoholic liquor only in the premises described in the application and license. No change of location shall be permitted. (Ord. 6982, 11-21-2006)
