4-4-9: SPECIAL EVENT PERMITS:
   A.   Permit, License Holders: Upon application in form prescribed by the commissioner and investigation and payment of a permit fee of twenty five dollars ($25.00), the holder of a class A, D or F license may be issued a permit to sell liquor as authorized by his classification outside of the permanent structure of his premises under the following conditions:
      1.   Sales must be made on the licensed premises as defined in original license application.
      2.   No sales will be permitted or consumption be allowed on any public property.
      3.   Notification must be given at least fourteen (14) days prior to the first day of the scheduled event.
      4.   The area used for special events must be enclosed or designated in some manner to mark the boundaries for special events use.
      5.   No liquor of any nature may be removed from the enclosed or designated boundaries for the special event. (Ord. 5175, 10-14-1987)
      6.   Special events permit shall not exceed ten (10) days per calendar year for any one licensed premises. (Ord. 5196, 12-9-1987)
   B.   Nonlicense Holders: Upon application in form prescribed by the commissioner and investigation and meeting all requirements for said event, a special events permit may be issued to the following nonlicense holders: 1) city of Alton (city sponsored event); 2) a not for profit corporation or other not for profit organization; 3) religious organization; 4) charitable organization; provided, however, that approval of a special events permit to any of the foregoing nonlicense holders shall be approved as follows:
      1.   Use of public parks must be approved in writing by the parks and recreation commission. However, no alcoholic beverages may be sold, given away or consumed in Rock Springs Park due to deed restrictions.
      2.   Use of any public property (including parks) must be approved by the city council. (Ord. 5175, 10-14-1987)
      3.   Any special event in any public park will be under the control and authority of the Alton parks and recreation commission. (Ord. 7303, 3-28-2012)
      4.   All special event permits are subject to final approval by the local liquor control commissioner. (Ord. 5175, 10-14-1987)
      5.   Fees for nonlicensed holder special events permits shall be twenty five dollars ($25.00) per day, and such events shall not exceed ten (10) days per year. (Ord. 5196, 12-9-1987)
      6.   No fee shall be charged for a special event permit issued to the City of Alton or any of its commissions, boards, or committees. In addition, there will not be a limitation on the number of days per year applicable to special event permits issued to the City of Alton, its commission, board, or committees.    C.   Special Events Of License And Nonlicense Holders: Upon application in form prescribed by the Commissioner and approval by the City Council, a not for profit nonlicense holder may be issued a special event permit for a specifically defined area under the following conditions:
      1.   The area used for the special event must be enclosed and designated for the special event. (Ord. 6521, 8-23-2000)
      2.   The applicant for the special event permit must provide a certificate of liability insurance to cover any portion of the designated area which is public property belonging to the City of Alton listing the City of Alton as an additional insured. Said certificate of insurance must be approved by the Commissioner prior to the special event. (Ord. 6768, 10-8-2003)
      3.   Any and all license holders located within the designated boundary of any special event held pursuant to this subsection C shall be allowed to sell alcoholic beverages, pursuant to the provisions of their respective licenses, in paper or plastic cups, to be transported by patrons throughout the designated special event area.    D.   Catering By Alton License Holders: Upon application in a form to be prescribed by the Liquor Commissioner, together with a two hundred dollar ($200.00) annual fee, the holder of a Class D or Class E liquor license may be issued a caterer liquor license to sell liquor as authorized by the licensee's classification outside of the premises applicable to the liquor license at various other locations under the following conditions:
      1.   Liquor sales must be made only in connection with a catering event. "Catering event", as used herein, shall mean an event which shall include as a principal portion of the event the preparation, delivery and/or service of foods prepared as would be customary in the operation of a restaurant or banquet facility. "Catering event", as used herein, shall not apply if the only service provided to those in attendance is the furnishing, delivery or service of alcoholic and nonalcoholic beverages.
      2.   The caterer liquor licensee must notify the Liquor Commissioner at least seven (7) days prior to the first day of any catering event to occur within the City of Alton. Said notification shall include the address of the catering event to be held, the owner or occupant of the property where the catering event is to be held, and the full identity of the individual or organization that has retained the services of the caterer for the catering event.
      3.   Proof of dramshop insurance coverage applicable to the service of alcoholic liquor at a catering event must be provided to the Liquor Commissioner.
      4.   A caterer liquor license issued pursuant to this subsection D shall be valid through the end of the calendar year in which the license is issued. No proration of the annual fee shall be made either in the initial grant of the caterer liquor license or in the event of its surrender, suspension or revocation. (Ord. 7189, 3-24-2010)
   E.   Catering By Non-Alton License Holders: The holder of a liquor license issued by the State of Illinois and a Local Liquor Control Commissioner other than the City of Alton may register with the City of Alton Liquor Commissioner for the privilege to do business within the City of Alton as an outside caterer. The person or business requesting to be approved to do business within the City of Alton as an outside caterer with the ability to dispense or serve alcoholic liquor must present the following information and/or documents to the City of Alton Liquor Commissioner as part of the registration process:
      1.   Proof of a valid license for the preparation of food for services off the licensed premises, issued by the appropriate licensing authority of the jurisdiction in which the applicant's catering business is located.
      2.   Proof of his, her or its ability to store, handle, prepare, transport and serve food in a safe and sanitary manner, in accordance with standards no less stringent than those imposed by the various regulations applicable to businesses within the City of Alton.
      3.   Proof of a valid license for the sale of alcoholic liquor, issued by the appropriate licensing authority of the jurisdiction in which the applicant's catering business is located.
      4.   Proof of dramshop insurance in an amount equal to that required of a licensee under this chapter. (Ord. 7171, 12-16-2009)
      5.   Payment of a fee per registration period, in an amount equal to the annual fee for a Class D liquor license as provided by this chapter.
Notwithstanding the provisions of section 4-4-3 of this chapter, if the Local Liquor Commissioner finds that a person or business has complied with all of the aforesaid requirements for registration of an outside caterer, the Liquor Commissioner of the City of Alton may issue a certificate of registration of a person or business as an outside caterer. A registered outside caterer shall be entitled to sell liquor at various locations within the City of Alton, but only under the conditions as set forth in subsection D of this section, which conditions are applicable to catering by Alton license holders.
The registration periods for each outside caterer shall be valid for the remainder of the calendar year in which it is issued. Renewal of a certificate of registration of an outside caterer shall be subject to all the requirements of the original certificate of registration of an outside caterer.
The Liquor Control Commissioner may revoke, suspend or levy a fine on the registered outside caterer for violation of any ordinance or law. Procedures for any revocation, suspension or levy of a fine shall be in accordance with the procedures applicable to a licensee of the City of Alton as provided in this chapter. Revocation or suspension of an outside caterer's license for the sale of alcoholic liquor or for the preparation and sale of food, issued by another jurisdiction, shall act as cause for revocation of the outside caterer's registration as an outside caterer in the City of Alton. A registered outside caterer must notify the Liquor Control Commissioner of the City of Alton of each and every suspension, revocation, fine or disciplinary action of any such license issued by another jurisdiction, no later than the second business day following the suspension, revocation, levy of a fine or other disciplinary action. Notification must be in writing, delivered by the outside caterer, or by messenger, to the Office of the Liquor Control Commissioner of the City of Alton. Failure to timely report any such action of another jurisdiction shall constitute cause for revocation of the privileges granted by the certificate of registration of the outside caterer by the City of Alton.
