4-4-4: CLASSIFICATION OF LICENSES AND FEES:
   A.   Classifications; Fees: Licenses to sell alcoholic liquor at retail shall be the following classes:
      CLASS A: Entitles the licensee to sell alcoholic liquor at retail for consumption either on the premises by the drink or pitcher or off of the premises where sold in the original package.
      CLASS B: Entitles the licensee to sell alcoholic liquor, in the original package only, for consumption off of the premises, but shall not authorize consumption on the premises.
      CLASS C:
         Class C-1: Entitles the licensee to sell beer and wine only, in the original package only, for consumption off of the premises, but shall not authorize consumption on the premises.
         Class C-2: Entitles the licensee to sell beer and wine only, in the original package only, for consumption off of the premises and by the drink or pitcher for consumption on the premises.
      CLASS D: Entitles the licensee to sell alcoholic liquor, by the drink or pitcher, as part of a restaurant business, for consumption on the premises only.
      CLASS E: Entitles the licensee to sell beer and wine only, by the drink or pitcher, as part of a restaurant business, for consumption on the premises only.
      CLASS F: Entitles the licensee to sell alcoholic liquor, at retail by the drink or pitcher, for consumption on the premises, or off the premises where sold in the original package, by clubs as the same are herein defined.
      CLASS G: Entitles the licensee to sell alcoholic liquor at retail for consumption either on the premises by the drink or pitcher or off of the premises where sold in the original package. A Class G license shall only issue to a golf course. Any business claiming to be a golf course for purposes of this section must document, upon demand, that fifty one percent (51%) or more of its gross receipts is derived from golf related activities, as distinguished from liquor.
      CLASS H: Entitles the licensee to sell alcoholic liquor at retail for consumption either on the premises by the drink or pitcher or off the premises where sold in the original package. A Class H liquor license may issue to the City of Alton, the Parks and Recreation Commission of the City of Alton, or to the authorized operator of the Alton Marina for the marina location at 1 Henry Street, Alton, Illinois, if in compliance with the requirements of and approved by the Local Liquor Control Commissioner of the City of Alton and so long as said licensee shall comply with the restrictions placed on the use of marina property by the United States Army Corps of Engineers on the premises.
      CLASS I: Entitles the licensee to sell alcoholic liquor at retail for consumption only on the premises as part of a banquet facility.
      CLASS J: Entitles the licensee to sell alcoholic liquor at retail for consumption on the premises of the Jacoby Arts Center at 627 East Broadway and on the surrounding area to the east and south consisting of approximately 18,000 square feet, including an outbuilding of approximately 2300 square feet, after said area to the east and south of the Jacoby Arts Center is developed into a park or recreation area. Outdoor consumption of alcoholic liquor shall be allowed in the aforesaid area to the east and south of the Jacoby Arts Center if purchased within the premises of said area or within the Jacoby Arts Center.
      CLASS M: Entitles the licensee to sell or deliver beer and wine on the premises of Rock Springs Golf Course and on the premises of Robert Wadlow Golf Course. The only entity entitled to receive a Class M liquor license shall be the entity to manage a golf course on each respective golf course named herein and only for so long as the entity is actively engaged in the maintenance and operation of a golf course.
      CLASS P: 
         Class P-1: Entitles the licensee to sell or deliver beer and wine at Gordon Moore Community Park. The Liquor Control Commissioner may issue a liquor license to the Parks and Recreation Commission of the City of Alton authorizing the sale of beer and wine upon the aforesaid premises, upon the request of the commission and upon proof that said commission shall provide and maintain dramshop liability with the maximum insurance coverage limits so as to save harmless the City of Alton, the Parks and Recreation Commission, the Commissioners, their respective agents and employees from all financial loss, damage or harm which may arise in connection with dramshop liability for sales related to the aforesaid license. Only the Parks and Recreation Commission shall be entitled to receive the Class P-1 license and only for the purposes and the premises hereinabove described.
      Class P-2: Entitles the licensee to sell or deliver beer and wine at Lloyd Hopkins Field in Gordon Moore Community Park during baseball games are related baseball activities of the River Dragons. The licensee of a Class P-2 liquor license must be preapproved by the Alton Parks and Recreation Commission before a liquor license may issue by the Alton Liquor Commissioner.
      CLASS R: Entitles the licensee to sell alcoholic liquor at retail for consumption only on premises under the ownership or control of an entity licensed by the State of Illinois to operate a riverboat gaming facility so long as said premises are contiguous to the docking facility of the riverboat so licensed.
   B.   Fee And Number Issued: The following limits are hereby established on the number of licenses to sell alcoholic beverages in the City:

      1.   Council Authority: By separate ordinance, the City Council may set a limitation upon the number of licenses to sell alcoholic liquor at retail to be issued for each classification of license. This restriction upon the number of licenses shall not limit the right to the renewal of any existing licenses nor to the issuance of a license to the purchaser of an established licensed business as a going concern, but as licenses are revoked, expire without renewal or for any reason cease to exist, then the total number of licenses for each classification shall be reduced until the total of each such class shall not exceed the number authorized by the city council.
      2.   Annexation: In the event that any establishment selling alcoholic liquor is hereby annexed to and becomes a part of the city, then the various alcoholic liquor licenses as enumerated in this section shall be increased in number only in the class which the annexed establishment(s) qualifies, and provided further, that the annexed establishment holds a current valid liquor license from the governmental entity from which said establishment was annexed and from the state.
