3-3-2: RANKS OF POLICE DEPARTMENT:
   A.   Chief Of Police: There is created the office of chief of the police of the city of Alton. The chief of police shall be appointed by the mayor, by and with the advice and consent of the city council, at the first regular meeting of the new city council of each year or in the event of a vacancy. The chief of police shall continue to serve until removed by order of the mayor or until his successor shall be appointed and qualified, whichever event shall first occur. He shall, in subordination to the mayor, have the full management and control of the police department, and all regulations and orders thereof shall be promulgated through him. All subordinate officers and members of said police department shall be subject to such rules and regulations as shall, from time to time, be prescribed by said chief of police.    B.   Deputy Police Chief: There is hereby created the position of deputy police chief, who shall be appointed by the mayor, by and with the advice and consent of the city council, at the first regular meeting of the new city council of each year or upon a vacancy. The deputy police chief shall continue to serve until removed by order of the mayor or until a successor shall be appointed and qualified, whichever event shall first occur. The deputy police chief shall perform such duties and have all such powers as may be lawfully delegated to him by the chief of police. In the event of the absence of the chief of police, vacancy in the office of chief of police, or at the request of the chief of police, the deputy police chief shall assume all powers and duties of the chief of police. The mayor shall have authority to determine that the chief of police is physically or mentally unable to perform his duties, and upon notification to the deputy police chief of such a determination by the mayor, the deputy police chief shall likewise assume all duties of the chief of police until relieved by directive from the mayor. Any acts by the deputy police chief, while properly performing the duties of the chief of police under the circumstances as aforesaid, shall be deemed acts of the chief of police for all purposes. The compensation fixed for the deputy police chief shall remain consistent and shall not increase during any period during which he assumes the duties of the chief of police.
   C.   Captain: The captain, under the general supervision of the chief of police and deputy police chief, shall perform such duties as assigned from time to time by the chief of police. The captain shall be a superior officer in the police department with authority over all police officers except the chief of police and deputy police chief.
   D.   Lieutenants: Lieutenants, under the general supervision of the chief of police, deputy police chief, and captain, shall perform duties that may include, but are not limited to, management responsibilities with advanced supervisory duties in the direction of uniformed or plain clothes police officers on an assigned shift or division. The lieutenants shall perform their duties as assigned by the chief of police from time to time.
   E.   Sergeants: Sergeants, under the general supervision of the chief of police, deputy police chief, captain, and lieutenants, shall perform duties as assigned by the chief of police from time to time, including, but not limited to, supervisory duties with regard to police patrolmen on an assigned platoon.
   F.   Patrolmen: Patrolmen, under the general supervision of the chief of police, deputy police chief, captain, lieutenants, and sergeants, shall perform such police duties as may be assigned by superior officers from time to time. They shall be governed in their activities by the regulations and directions of their superior officers.
   G.   Personnel: The position of police officer of the city of Alton is hereby created in addition to the chief of police and deputy police chief, who shall be police officers. Persons may be appointed to serve as police officers of the city of Alton with the various ranks as follows:
      1.   Chief of police.
      2.   Deputy police chief.
      3.   Captain.
      4.   Lieutenants, not to exceed six (6) in total.
      5.   Sergeants, not to exceed fourteen (14) in total.
      6.   All others with the rank of patrolmen.
   H.   Appointment And Promotion: Captain, lieutenants, sergeants, and patrolmen shall be appointed and promoted by merit in accordance with the statutes, rules and procedures relating to the function of the civil service commission of the city of Alton, Illinois.
   I.   Existing Contract: The adoption and approval of this section is not intended to negate or nullify any of the respective rights or obligations of the parties with regard to the existing contract between the city of Alton and Police Benevolent & Protective Association Unit #14, covering the period April 1, 1999, to March 31, 2004.
