2-15-4: APPLICATION:
   A.   Filing Procedures: Fifteen (15) complete applications, accompanied by the required filing fee shall be filed in the office of the city clerk of the city of Alton for any proposed facility or the expansion of an existing facility within the city. The application shall contain sufficient details describing the proposed facility to demonstrate compliance, including all site plans, exhibits and maps. The date an application, including the filing fee, is filed with the city clerk shall be considered the official filing date for all time limit purposes.
   B.   Filing Fee: A filing fee of two hundred fifty thousand dollars ($250,000.00), paid by a cashier's check, shall accompany an application. Said fee shall be used by the city to defray any costs incurred by the city in processing the application including, but not limited to: hearing officer(s), court reporter, transcription services, public notice, building rental, committee per diems (to be determined by the city council from time to time), staff review, attorneys, city consultants (i.e., engineers, traffic experts, land planners, and their tests, exhibits and testimony and travel expenses) and any other relevant costs incidental to considering the application. The fee shall also cover the city's costs of preparing a record sufficient to form the basis of an appeal of the city council decision to the Illinois pollution control board.
In the event the costs exceed the filing fee, the applicant shall pay to the city an additional fee of fifty thousand dollars ($50,000.00) within five (5) business days of being notified of the deficiency. The city will send the applicant regular invoices for the fees and costs incurred. In the event a balance remains, the surplus funds will be returned to the applicant upon written request of the applicant.
   C.   Amended Application: One amended application may be filed pursuant to the act. In the event the applicant files an amendment, an additional deposit of fifty thousand dollars ($50,000.00) shall be filed with the amendment. The fee shall be paid by a cashier's check.
   D.   Public Record: The application and all related documentation shall be available for public inspection in the office of the city clerk. Any request for copies of the application and/or related documentation shall be made available at the cost charged by the city for freedom of information act requests.
   E.   Public Notice: The applicant shall be responsible for publishing any required public notices and sending any notices required by 415 Illinois Compiled Statutes 5/39.2. Proof of all notice requirements shall be filed with the city clerk prior to the first hearing date.
   F.   Public Hearing: The committee will operate pursuant to the articles of rules and procedures found in section 2-15-6 of this chapter. During the course of the public hearing before the committee, all testimony shall be recorded. Testimony shall be received from the applicant, the applicant's witnesses, any city witnesses and any other witnesses or objectors. (Ord. 6769, 9-24-2003)
