12-4-3: EASEMENTS:
   A.   In general, utilities shall be placed within publicly dedicated street or alley right of way. However, where practical difficulties exist in providing utilities within dedicated street or alley right of way, utilities may be placed within an easement dedicated to the city, or other appropriate entities. Such easements shall be located adjacent to and parallel with street rights of way, wherever possible, with side and rear yard easements being discouraged. The width of easement dedications for utilities shall be as follows:
      1.   A ten foot (10') easement width total is required when the easement includes telephone lines, power lines, city lights, television or telecommunication cable, gas mains, water mains or other utilities.
      2.   A fifteen foot (15') easement width total is required when the easement includes one sewer system with or without any of the items specified in subsection A1 of this section.
      3.   A twenty foot (20') easement width total is required when the easement includes both storm and sanitary sewer systems with or without any of the items specified in subsection A1 of this section.
   B.   No person shall erect any structure, plant any tree or shrub, or place any obstruction in any easement or within any public right of way, except at the property owner's risk with respect to all costs for demolition, removal, reconstruction, or replacement thereof. (Ord. 6104, 12-18-1996)
