12-2-7: FINAL PLAT; WHERE FILED:
   A.   Upon meeting the conditions of chapter 3 of this title, the subdivider shall file an original and three (3) copies of the final plat of the proposed subdivision, and all supporting documents, with the City Clerk. In addition, the subdivider shall submit an electronic copy of the final plat and all supporting documents in portable document format (PDF), or other format approved by the City of Alton, to an e-mail address provided to the subdivider. Such final plat shall be referred by the City Council to the Plan Commission. The Plan Commission shall consider the same upon the scheduling of a public hearing by the Department of Planning and Development. Furthermore, the final plat shall be forwarded to all appropriate City departments for their review and comment prior to the public hearing. (Ord. 7463, 6-10-2015; amd. Ord. 7664, 8-22-2018)
   B.   In addition, the following supporting documentation shall be submitted simultaneously to the Clerk:
      1.   A certificate from the County Clerk of Madison County certifying that there are no delinquent general taxes, unpaid current general taxes, delinquent special assessments or unpaid current special assessments against the tract of land to be subdivided. An accurate legal description needs to be included in the certificate.
      2.   A construction bond, if required.
      3.   The perpetual maintenance of any common areas shall be provided for by a declarant legal entity. Prior to final approval of the subdivision, the Plan Commission must approve the subdivider's selected method of perpetual maintenance. The subdivider shall make no change in the approved method unless the Plan Commission and City Council approve. If a homeowners' association is to be formed, the articles of incorporation must minimally contain the following provisions:
         a.   Legal description which geographically defines the area owned and controlled by the homeowners' association.
         b.   That all owners of property within the development shall automatically become members of the homeowners' association and shall be required to incur all costs necessary to maintain any facility or common facility of the association. (Ord. 6104, 12-18-1996)
